Mangaluru diocese denies land encroachment by Bishop

Mangaluru, Feb 1: Diocese of Mangaluru has denied the land encroachment charges leveled against Bishop of Mangaluru. A section of the press had carried a report on this issue. In the light of this development, the diocese has issued the following statement.

“The properties are held by Lord Bishop of Diocese of Mangaluru and its institutions legally. We have not encroached either any government land or committed any illegal acts. St Joseph Asylum has filed eviction case against Valerian Texeira and Victor Pais and the same is pending in the court of law. Hence to defame us with the false allegations, a complaint was lodged with the Upa Lokayukta on 28.01.2018. During investigation, it was found that there is no substance in the allegations and the Upa Lokayukta held that he has no jurisdiction in the matter. Order of the Lokayukta is as follows:-

“This complaint is filed against Dr Aloysius Paul D’Souza in Lord Bishop, Mangalore Diocese Bishop House, Kodialbail, Mangalore D.K. Dist. Since Respondent being private party Lokayukta institution has no jurisdiction to take any action.

"However having regard to number of people involved in this complaint and having heard their grievances, it appears that they have been residing in the Property in their occupation since several decades. They claim that lands for which they are occupying are the government lands and they are sought to be illegally evicted by the Respondent,"

"It is only for considering as to whether the land so acquired by the complainants are government lands or whether the complainants have any right for the same or whether the district administration has any alternative provision to protect the interests of the complaints without invading the private rights of the Lord Bishop. With this background, assistant commissioner (AC) Mangalore sub Division and tahsildar Mangaluru Taluk have been asked to verify records relating to this issue and submit report by within 20 days. AC Mangaluru sub Division and tahsildar Mangaluru are impleaded as R2 and 3 call on 17.02.2018”.

"What Lokayukta has ordered is that whether the land occupied by the complainant is a government land and whether they have got any right for the same. Hence enquiry is actually against the complainants and they have to prove their rights. Inspite of the same, in some of the media, false information was published saying that Lokayukta has ordered for enquiry against the Bishop. There is no enquiry against the Bishop regarding illegal encroachment. No such enquiry is ordered by the Upa Lokayukta against Bishop. Lord Bishop has required documents regarding the lands held by him. On the other hand, Upa Lokayukta has upheld the rights of the Bishop. The complainants are occupying the land provided by the Diocese of Mangalore on humanitarian consideration for their use and occupation on a meager rentals. Hence allegations against the Lord Bishop of Mangalore is absolutely false."

Fr William Menezes, public relations officer of Mangaluru diocese has issued this statement on behalf of the dicocese.

    The land belongs to the diocese & diocese is for the people & by the people. So evict the people who are staying there and make all members of the parishes & diocese as equal shareholders. Problem solved. This would make things more transparent. But new members need to wait for a certain period of time before becoming shareholders.

    Whatever Diocesan authorities are doing in Jeppu, may be legally correct but humanly wrong. The land was not originally purchased by the Diocese , but was donated to the Jesuits , for charity purpose which was later handed over by Jesuits to the Diocese. Under whatever legal rights these families were staying there, fact is that they are there since more than fifty years. Also these families are not encroachers. So Diocese should consider this case not like any other property matter. May be , few decades ago, these Jeppu residents must not be having the legal knowledge to build up necessary documents to prove their land rights. That does not give a automatic authority to Bishop to try to evict them.
    In my view, Diocese is giving a wrong message to the community by doing this. Rather, chose a path of dialogue or give away the land to the persons who were staying there since more than fifty years.
    It is not correct to state that Lokayukta has asked the jeppu people to prove their rights. If Diocese is having the original documents, what stops Diocese to call a Press meet and display the documents? Is it necessary for Tahasildar to search and report ? And also in many parts of the Diocese, there are many cases where diocese does not have original documents. In such case, whether Diocese is going to return the land to original land owner or to the government? If Diocese is asking the land back from Jeppu residents, Diocese should also return the land it holds without proper documents in various parishes. Do we agree for this? No. Then why a different logic for Jeppu residents ?

    @Amith USA,one more point to be noted,church cant afford to leave the vacant excess land .because Govt.immediately ask and try to grab.,so they try to build school,hospital or whatever or Ashram like .even house , church.Many faithful people who donate the land to the church when they dont have children .or a favour recieved .

    This is the result of the complete mismanagement of the church properties by the concerned people. As a result the Bishop is getting a bad name. More competant people should be appointed and such bad publicity can be avoided.

    I am unable to comment on this allegation levelled against the Bishop as I am unaware of what is going on. However, it is pertinent to point out that this is not the first time the Bishop's office is in the news as far as allegations are concerned. I have heard a lot of stories doing the rounds although most of them are unsubstantiated. That, however, reminds me of the saying, "There is no smoke without fire." How much of all this is true and how much is untrue, well it is only Jesus Christ who is aware of all that is going on and we should not lose sight of the fact that finally we are all answerable to Him. We, including me, might be able to get away from all this in this world but how are we going to dodge Him?

    Live with the people of Jeppu - and see in name of religion how religious people are making use of their so called legal land. Luxury community halls - where benefits will only be for the religious people. Hear the people out and see their distress. Just because they are religious people it doesnt mean what they do is all right. To believe meet the residents of Jeppu.

    Luxury community hall, is not the basic necessity.

    Very valid point. In 1974 the land reform act came into existence and the tiller of the land became the owner. But shortly, after getting the ownership, many have sold the land.

    Here too, to a certain extent, the dwellers might be trying to sell the land to the real estate for better price, where the dwellers are only possessing the land, but the y are not rightful owners of the land.

    Only rightful, owners of the land have the power to sell the land/property.

    People of Jeppu do not want to sell property they just need their ancestral place. The place where great grandparents, grandparents, parents and children live - their memories. People who know the value will know the importance of it. If you cant empathize dont sound so aggressive.

    @Amith USA,for your kind information none of church property will be sold to any builders or privateiers.Because it is the source to lookafter maintaining costs of churches .Same with Evangelists.Here too churches have some land they give on rent,but never sell.you can build a house on it,or cultivate ,but is not your own land.rent is cheap comparing to private people.

    My only question is how church got its ownership of such a very huge land and it they bought it from whom. If church has records than it belongs to the church and these accusers what to grab the rented plot from church authority.

    Best solution could be, church instead retaining power over it, sell off the land to residents itself to a nominal price.

    Secondly, for a peaceful solution, status quo should be maintained and church should withdraw the notice served to two/3 families despite whatever may be the reason. Let us make path straight christian spirit must prevail over vengeful spirit.

    It is sad to hear that some vested interest is behind this scene.
    People in Jeppu are residing there from many decades without any issue. It is not true to say that they are converted few years ago. These people might have converted may be more than 3 to 4 centuries. These priests even built houses for them, there is ground, club etc. I think the diocese has given them more benefits than any Christians of the dioceses .They have to see the plight of their Christians who struggle to build a small house or even to get a small piece of land. I think some people who want sell these lands are making these issues. Some people who have sold the free property they got from dioceses are behind this issue.
