Bengaluru: HC grants interim stay on probe against Yeddyurappa


Bengaluru, Sep 22 (DHNS): In a temporary relief for state BJP chief B S Yeddyurappa, the Karnataka High Court today granted an interim stay on FIRs filed by the Anti-Corruption Bureau against him for alleged illegal denotification of land by him as chief minister.

Justice Aravind Kumar granted the interim stay on the grounds of lack of sufficient material to prove cognisable offences of Yeddyurappa under the Prevention of Corruption Act or IPC, both in the complaint and preliminary probe conducted by ACB.

"After hearing both parties, this honourable court finds lack of material in the complaint and preliminary investigation conducted by ACB for registration of the FIRs against the petitioner, in this case Yeddyurappa, and hence this honourable court grants interim stay on the matter," Justice Kumar said.

The judge observed that the inordinate delay in registering the FIRs after receiving the complaint against Yeddyurappa raises suspicion about the intent of ACB, which is under the control of Chief Minister Siddaramaiah.

Two FIRs had been filed against the BJP leader, based on a complaint by a member of the 'Jana Samanya Vedike', a social organisation.

"The considerable delay caused by ACB to register the FIRs also caused prejudice to the accused (Yeddyurappa)," he said.

Yeddyurappa had alleged that ACB was being used to target opposition leaders in the Congress-ruled state "in retaliation" to the recent Income Tax raids on Karnataka Energy Minister D K Shivakumar.

Justice Kumar also took cognisance of Yeddyurappa's submissions that the ACB had not followed its own rules, like seeking sanction from competent authority before registering the case.
He had alleged that the FIRs against him stemmed from "political vendetta and malafide intentions".

Yeddyurappa had moved the court seeking quashing of the ACB proceedings against him in the case.

He has been accused of denotifying 257 acres of land out of 3,546 acres meant for Dr K Shivaram Karanth Layout, "bypassing" the Bengaluru Development Authority when he was the chief minister between May, 2008 and July, 2011.

    Yediyurappa is a most disputed and most unaccepted leader for CM post in Karnataka. All his problem was made by himself during CM of Karnataka. BJP promised many but did not implement any. Implementation of Demonetisation by BJP govt the GDP of India crushed. GST brought by BJP Govt is another burden to the the medium and low income group people. BJP gives one over another blow to the people of India. Crude oil is below 50 dollor per barrel but the price of Diesel and Petrol goes up daily which gives direct impact on commodities. Why BJP is not bringing Petrol/Diesel under GST. Any people of Karnataka wants any leader for BJP, who will giver further burden to the people of Karnataka...

    Yediyurappa is a undisputed and most accepted leader for CM post in Karnataka.All his problem was not made by himself but created by paid people from Italian matha using heavy weight sobgaga.
    Bad about BJP is that it's image diminished due to improper planning and implementation of Demonetisation by Modi govt more particularly by FM Jaitly.Induan GDP is under crush and we are facing the situation being branded as a junk state.Deminetization has all mist killed Indian economy ahead of grave global recession.Common man is suffering due to high prices of daily essentials coupled with unreasonable high price of petroleum products.FM is harping on additional revenues as a reason for not bringing down fuel prices.Such a stupid theory we have listen now.
    God save India and our common people.Rich people have no problem in the country.

    In 2014 general election BJP promised the nation 'corruption free' India. But when it comes to Karnataka BJP has only one hopes in disgruntled leader Yeddyurappa who was on bail from jail for mine kickbacks and denotification.

    In Bellary mine kingpin Janardhan Reddy case High Court judges is offered Rs50 Crores in 'bail for sale'
    scam. The scam tainted judge was later found dead in Hyderabad in mysterious circumstances. In Yeddyurappa case too money may have played granting stay in the view of elections.

    Ironically, Court of India which suppose to give judgement based on truth is obstructing the investigation proceedings.
    Chief Justice of India is shedding tears in front of Prime Minister of India saying overburden of cases.
    The High Court of Karnataka is deliberately obstructing the legal proceedings in peer political pressure.
    Is our Indian Judiciary is heading for banana republic? How does the this single judge can stay the corrupt being prosecuted?
    If politicians can get stay then why not rapist,murderers, anti nationals can get the same privilege?

    Joseph Bhai, don't worry about church attack. People can buy judiciary by money and power. However, they can not bribe God's justice. Couple of people who supported church attack have paid the price by hanging themselves, heart attack etc. Few are remaining to suffer more. God is watching everyone including those who support the church attack.
