Mangaluru: Man who raped, cheated lady gets seven years imprisonment

Mangaluru, Oct 12: The second additional district and sessions court here has awarded seven years imprisonment to a man who raped a lady after convincing that he would marry her later. However, he cheated on the promise. The court awarded imprisonment to him after finding that the charges levelled against him have been proved.

Ganesh Kumar (34) from Kuntalpady, Shaktinagar, was held guilty in this case.

The court, after concluding hearing in the case, arrived at the conclusion that the accused was guilty of committing rape, for which seven years imprisonment and Rs 5,000 fine were imposed. He was given six months imprisonment for cheating, and six months for posing threat. Six months imprisonment and fine of Rs 2,500 were ordered under Prevention of Atrocities against Scheduled Castes and Tribes. If he fails to pay fine, he will have to undergo three more months of simple imprisonment, the court said. The judge stated that the affected lady is eligible to get compensation from the district legal services authority.

Ganesh used to work as contractor in the city. He had come in contact with a lady from Hassan district, who used to work as housemaid. They came closer and were close from 2010 to 2013, during which period the youth had taken her to various lodges by doling our marriage promise and had physical relationship with her. He also used to make her wear artificial Mangalya chain and toe rings to show that they were married. On October 12, 2013, she was taken to near Kadri Hill in a car where she was reportedly raped again.

When both of them were sitting at Kadri Hill together, the lady had noticed that Ganesh received messages from another girl. She also came to know that he was trying to marry another girl. She insisted that he should marry her, at which the youth got angry and reportedly derided the caste to which she belongs. The lady then filed complaint of rape in the rural police station here.

Thereafter, Ganesh, fearing police action, promised to marry her and made preparations. On the day of proposed marriage, he went absconding. The lady then filed complaint in the women's police station here on march 19, 2014. During the trial, Ganesh tried to prove that he was not capable of having sex but failed to provide supporting documents. He had introduced the lady as his wife to many people.

28 witnesses including manager of the lodge were listed in the case as witnesses, out of which 18 adduced evidences. Public prosecutor, B Shekhar Shetty, appeared on behalf of the prosecution.

City central sub-division assistant police commissioner Tilak Chandra conducted initial investigation while Sadananda Varnekar filed charge sheet. Judge of the court, B R Pallavi, announced the quantum of punishment.
