Mangaluru, Sep 3: The special court under Narcotic Drugs and Psychotropic Substances Act here has held Imtiaz (28) from K C Road Kotekar guilty of ganja trafficking. It has imposed sentence by way of five years of rigorous imprisonment (RI) and fine of Rs 50,000.
Imtiaz had been named as accused in a case registered by Kavoor station police in December, 2016 on the allegation of ganja trafficking. At the same time, the court absolved second accused in the case, Abdul Aziz, for want of evidences. The court also has ordered for the impounding of motor bike used for selling ganja.
Kavoor police had got information that two motor bike-borne youngsters were selling ganja near Guddeangady Rayikatte on Kulur-Kavoor Road at about 4.45 pm on December 19, 2016. The then police inspector of the station, M A Nataraj, sub-inspector, Umesh Kumar, and other personnel had raided the spot and held Imtiaz along with two kg ganja and motor bike. Abdul Aziz escaped from the spot. The accused and assets were taken into custody in the presence of corporator, Dayananda Shetty, who was present at the spot.
Inspector of Kavoor station, K R Naik, concluded investigation and filed charge sheet in the court. Judge of the special court, Kadlur Satyanarayana Achar, who completed hearing on Saturday, declared Imtiaz guilty of the charge. He also ordered Imtiaz to undergo six months simple imprisonment in case of failure to pay fine. Out of the jail term, the term of seven months already spent inside jail by the accused in judicial custody would be deducted.
On behalf of the prosecution, special public prosecutor, Pushparaj Adyantaya, had presented this case.
