Verify church blasts convict's medical condition - SC tells state


New Delhi, Apr 5 (DHNS): The Supreme Court on Wednesday asked the Karnataka government to verify the medical condition of a convict as he has been in jail for about 18 years after having been convicted and awarded life imprisonment for carrying out a series of blasts at various churches in the state in 2000.

Hearing the bail plea of Syed Mohammed Ibrahim, a bench of Justices R K Agrawal and Abhay Manohar Sapre asked Additional Advocate General Devadatta Kamat to ascertain his condition as his counsel Kamini Jaiswal contended that the 70-year-old petitioner lodged in central prison, Belagavi, suffered from several ailments and was seriously ill.

The counsel contended that some of the accused had died during the pendency of appeal in the top court. She submitted that the petitioner could be granted bail after imposing any condition.

"Whether continued incarceration of the petitioners was justified just because they belonged to a particular community? They are in custody for over 18 years, while during the pendency of appeal, one more accused had died," she contended.

The counsel also submitted that the petitioners were said to be belonging to Deendar-Anjuman organisation, which was proscribed only in 2005. She said the petitioners, who faced similar charges in Andhra Pradesh, were imposed a jail term of a mere six months, while in a case in Goa, they were acquitted.

The court, however, directed the state government's law officer to verify the medical condition of the petitioner and posted the matter for consideration on April 12.

The convicts were alleged to have conspired and carried out the blasts at different churches in Bengaluru, Hubballi and Kalaburagi among others. They challenged the December 14, 2014 order of the Karnataka High Court that upheld their conviction in the case. The HC had commuted the death penalty awarded to them by the trial court to life term.

On June 8, 2000, two consecutive blasts took place at St Ann's Catholic Church, Wadi, Chittapur taluk, Kalaburagi district in three hours. The second blast took place on July 8, 2000 at St Lutheran Church in Hubballi between 3.30 am and 4.30 am.

The third blast was carried out on July 9, 2000 at 10.15 pm at St Peter and Paul church on JJ Nagar Main Road, Bengaluru.

    Must be reprimanded S.P., Satish, V.S. Acharya, Deputy Commissioner Maheshwara Rao, Yeddy, Bajrangdal leaders and V.H.P leaders.

    CRIMINALS AND CULPRITS OF THE CHURCH ATTACKS SHOULD BE JAILED IMMEDIATELY.

    THERE WERE MANY CHURCH ATTACKS, TEMPLE ATTACKS AND MOSQUES ATTACKS DURING THE TIME OF

    BESHARAM JHOOT PARTY.

    This is a living example of how the politicians apply use and throw policy. While politicians are scott free the small flies are caught and languish in jail.

    If this prisoner has repented and apoligises to catholic community with an undertaking that he will not attempt such acts and instigate others to such acts then he may be forgiven and set free because now 2019 elections are due so need to take care of all fringe elements.

    Media like times of india, republic tv, aaj ki addalat, aaj tak never expose such news, so that other fringe elements are warned before they get instigaged.

    If all criminals r given amensty like you feel I think there is no need of any law or police .just do the criminal activity and then please for forgiveness .this will be like a person killing his parents and pleading that he is an "orphan " and to be released

    @ Rathan,
    you are mistaken under the impression we catholics are forgiving because the accused is muslim but even if it was hindu and repented we would have forgiven. what i actually wanted to convey is that fringe elements should not be instigated by politicians . It is the politiicans who should be jailed for instigating and giving money for such inhuman acts.

    But one more thing if because of this act any innocent person died than I dont agree the accused to be forgiven. Let court decide.

    The supreme court itself telling HC to verify and I have already mentioned if people killed then no mercy. what about the politicians who instigated dont you think they deserve equal punishment??

    Ask yourself one question - do you seek justice or do you seek revenge? You do not have to respond to this question.

    I believe you are a logical person and your innate sense of right and wrong will tell you whether a 70 year old man who has been incarcerated for 18 years and in all likelihood suffering from sever psychiatric issues deserves to die in prison? Bear in mind that the 70 year old man is almost certainly not a threat to society anymore.

    No one comes out of their mothers womb with a criminal record or as a terrorist. As a mature society, we cannot just discount the lack of education and opportunities that invariably bugs the marginalized section of our own people and then condemn them to death. It is very easy for the judiciary to sentence a poor man to death / lifer and then let rest of the society go in their merry way that 'justice' has been served.

    You said"all human rights applies only to terrorist". You mean to say terrorist means who attacked Mangalore Church, pub attack etc who have been given clean chit by our great court recently for not having full evidence, witness, inspite the whole world has witnessed this heinous act.
