New Delhi, May 5 (IANS): Nupur Talwar Friday told the Supreme Court that there were several inconsistencies in the CBI investigation in the Aarushi Talwar-Hemraj double murder case in which she is an accused.

She sought quashing of the trial court order rejecting the CBI's closure report and taking cognizance against her and her husband, Rajesh Talwar.

The apex court bench of Justice A.K. Patnaik and Justice Jagdish Singh Khehar was told that the trial court could not accept or reject the closure report in parts by letting off some and taking cognizance against the others.

Senior counsel Harish salve appearing for Nupur Talwar told this to the court while arguing her plea seeking review of the apex court order of Jan 6, 2012, directing the dentist couple to face trial.

The Talwars had challenged the trial court order of not accepting the CBI's closure report in the case and taking cognizance of the offences against them. The trial court had also rejected the Talwars plea for further probe in the case.

The Talwars are facing charges of murder, conspiracy and destruction of evidence.

"Closure report is for everyone," Salve said arguing that while there was evidence against Talwars' servant Krishna but the trial court discharged him, and though there was nothing against the dentist couple they were made accused.

The court was told the foot prints on the terrace room of the Talwars house from where their servant Hemraj's body was found were not that of Rajesh Talwar, but the same fact was not mentioned in the CBI's closure report. He said that this is there in the investigating agency's records.

Similarly, the post mortem report says that there was no abnormality on the private parts of Aarushi Talwar, but subsequently the doctor who conducted the post mortem kept making statements beyond the original report which were relied upon by the investigating agency.

In December 2010, the CBI filed a closure report in the case before the special court in Ghaziabad, but stated that it had circumstantial evidence against the Talwars in Aarushi's murder.

However, Talwar approached trial court against the closure, demanding further investigation. The court too rejected the closure report, and in a dramatic twist, summoned both the parents to face trial, and directed the CBI to prosecute them.

Aarushi, 14, was found brutally murdered in the Talwars' Noida residence on May 16, 2008. The body of their domestic help Hemraj was found the next day from the terrace of the house.
