Mangaluru, Dec 1: Relating to the murder of Mescom engineer, Jagadeesh, residing at Chandika Extension, Kadri Kambla Road, Bijai here, the third additional district and sessions court here has exonerated both Siddappa alias Siddu (32) from Belagavi and Murtuza Khadri (34) from Davanagere, of the charge of murder levelled against
them.

The accused reportedly entered the residence of Jagadeesh after he and his wife retired to bed on the night of September 20, 2014 by breaking open the door. With the purpose of robbing the gold ornaments, they entered the bedroom of the couple and sliced the throat of Jagadeesh. His wife, Bharati, who woke, raised an alarm, at which the accused fled. Immediately Bharati called Dr Ganapati Bhat residing nearby. Dr Ganapati Bhat and Dr Ashok who rushed to the spot, found that Jagadeesh had died by then. A police complaint was filed and finger print experts and sniffer dogs had surveyed the spot of crime.

Urva police who registered the case arrested the accused when they were in KSRTC bus stand on the basis of suspicion. During the questioning, they confessed to the crime. Bharati identified the culprits as she had seen them. Kadri police inspector had filed charge sheet in the court.

The prosecution claimed that both the accused, who were coolies, had taken to theft at nigh for making extra money.

Judge of the third district and sessions court, Muraleedhar Pai, who conducted hearing the case, came to the conclusion that the prosecution had failed to prove the charges against the accused. He therefore, exonerated the accused. Advocates, Venukumar and Yuvaraj K Ameen, had appeared in the case on behalf of the accused.

    It now needs to be seen whether Public Prosecutor & govt go in appeal against the order. If they don't we all will know what has transpired. The victims wife & community must protest & build pressure on govt.

    Thought its sad that, there is nobody held responsible for murder and life is lost . There are many readers express their shock on this judgement just reading the article and not going through the judgement . Its not easy for a judge to acquit the accused when there is sufficient evidence against them . We know from media, finger prints are matched with accused & Bharati 's identification of them but why judge did not consider them valid only detail judgement can tell . There are many cases of fabricated cases by police which is not a hidden secret . People with legal background and who are involved in such cases can tell the facts better ...

    Anil- if they are not culprits, they would not have confessed to the crime...
    I believe confession comes in front of the court? And judge too questions them personally ?

    suppose if they are not real murderers then court need to order the arrest of real culprits. That is the procedure. Police need to find them out. They have finger print isn't it.

    I cannot really understand the working of these courts ... Some procedures are not followed by courts.. They are government employees anyway... who will question them?

    Absolutely Ridiculous judgement... Similar to the pub attack case... The essence of the offence has been missing... Judge must be a half baked Lawyer .. now by virtue of his connection's made a judge... Common sense not used ... Or did the loot distributed ?? They had finger prints, accused admitted the crime, wife identified.. so what was lacking ? Judge could have reserved the judgement.... God save the only hope of us commoner's.. the Judiciary

    They arrested two people and the arrested people confessed the crime....!!!!
    Bharti identified the culprit.
    And the police failed to check the finger prints......????
