Bengaluru, Feb 21: The lawyer representing Mohammed Nalapad, who was expelled from the Congress for assaulting a man, has told the court that Nalapad's name does not appear in the complaint, and hence he should be granted bail.
"There is no mention in the complaint copy that Nalapad Mohammed Harris assaulted Vidwath. It is mentioned in the complaint that after the initial verbal exchange of words, 10 to 15 people assaulted Vidwath. So bail should be granted to the accused," Nalapad's lawyer told the court while applying for bail for the accused.
The lawyer defending Nalapad who applied for bail in the sessions court questioned the action taken by police and said. "Attempt to murder (307) section has been registered on my client due to political pressure. There is no provision in the law to include another section after many hours of registering the FIR. It is not correct to have registered this case owing to external pressure. The case should have been registered based on the complaint."
As the police custody of the accused is expiring on Wednesday, February 21, Nalapad's lawyer approached the court to prevent the accused from being sent to prison. The bail application will most probably be taken up for hearing on Wednesday, February 21.
Possibility of police custody again?
In the midst of the bail application from the lawyer of the accused, there is a possibility that the police may ask for more time in police custody as they have to carry out the spot inspection of the places where the incident took place.
Multi-crore scam reason for assault: HDK
Meanwhile JD(S) state president H D Kumaraswamy alleged that a 'multi-crore scam' was reason behind the assault on Vidwath.
"Mohammad Nalapad, son of MLA Harris, did not assault Vidwath for stamping his leg. There is a scam of crores of rupees involved in this incident," the former chief minister told reporters in Hubballi.
"Computer hacking, bitcoin and havala business worth crores are involved in this scam. Cybercrime department has to investigate this thoroughly and publish the reality.
"There is an attempt to close this case without inquiry. Rowdyism shown by Mohammed Nalapad shows the mentality of Congress leaders. Narayanaswamy, a close aide of Siddaramaiah has shown his goondaism at the BBMP office. Strict action has to be taken against him too," Kumaraswamy said.
