Mangalore, Jun 21: The state High Court has upheld the verdict delivered by the appellate tribunal of the education department and dismissed the writ petition filed against the decision by the governing council of SMS College Brahmavar, Udupi district, relating to the reinstatement of dismissed faculty member, Prof Immanuel Lalit Kumar.
OSC Education Society runs SMS College Brahmavar. The state High Court has taken a serious note of the fact that the society chose to dismiss Kumar from services without holding any inquiry against him. It has upheld the observation of the tribunal that the allegations levelled by the management are not backed by facts, and that the professor should be reinstated forthwith without any pre-conditions.
The appellate tribunal for education in Udupi, in its decision, had observed that the governing council of the college had failed to apply the principle of natural justice in the case. It said that the management, which is expected to serve the interests of its employees, had committed serious lapses by not providing an opportunity to the employee to defend himself.
Association of Mangalore University College Lecturers, and Federation of University and College Teachers Associations in Karnataka, have welcomed the decision, and demanded the college to reappoint Prof Immanuel without any delay.
