Udupi, Mar 30: The court of the chief judicial magistrate here has ordered for trying of those accused, whose names had been dropped from the charge sheet, relating to the fraudulent sale of a private land.

Explaining the circumstances under which these orders were passed, retired professor, Wilfred R D’Souza, who holds power of attorney in the case of the contentious land, said in a press conference held here on Tuesday March 29, that Gilbert D’Souza, presently settled in the USA, had bought the said land from Fr Peter Theodore D’Souza, principal of Kallianpur Milagres College residing in Kelarkalabettu here. However, later, the land was sold to Ancilla Jyoti Fernandes through a sale deed.

Gilbert, who came to know later that the land he purchased had been sold clandestinely, complained to the court against those who sold the land and the purchaser. The case was forwarded by the court to the circle inspector here. However, the policemen, in their charge sheet, named only Fr Peter Theodore D’Souza, and Ancilla Jyoti Fernandes only. They had deleted the names of the other three accused, Fr Marcel Saldanha, advocate, Tony D’Souza, and his employee, Shiba C J.

When the case came up for hearing, after the insistence of the concerned to include all the accused who were left out of the charge sheet in the case, the court has ordered inclusion of their names, Wilfred explained.
