Election should not be stayed in Karnataka, EC on MLAs' disqualification row


New Delhi, Sep 23 (IANS): The Election Commission told the Supreme Court on Monday that elections should not be stayed in the disqualification row over Karnataka MLAs.

"Speaker can disqualify but can't deprive the MLAs from contesting," said the EC.

The apex court has issued notice to Karnataka Congress leaders Dinesh Gundu Rao and Siddharamaiah, JD-S president H D Deve Gowda and the Assembly Speaker on the disqualified MLAs' plea.

The MLAs have pleaded that they should be allowed to contest bypolls scheduled on October 21.

Senior advocate Mukul Rohatgi appearing for the disqualified Karnataka MLAs urged the Supreme Court to suspend the bypolls in their constituencies.

Rohtagi also urged the top court to issue interim orders so that petitions don't lose relevance specifically keeping in view the impending bypolls. The top court will hear the matter on Wednesday on the pleas of ex-Karnataka MLAs against their disqualification by Speaker under anti-defection law.

The MLAs seek a stay on their disqualification which will enable them to contest by-elections. Nominations are due on September 30.

    EC should made a law, one should not be allowed to change party more than one/two time, after that they will be disqualified permanently. once they change they should not be allowed to context for 5 / 10 years from change.

    The disqualified MLAs should not be allowed to contest the election.
    People voted with trust and faith to these uneducated MLAs.
    For the sake of money they strangle the trust and faith entrusted on them.
    These MLAs resigned only to favour BSY to become CM.
    EC does it know how much money being spent on conducting the bye election due to these uneducated MLAs.
    Poor people suffer coz of these bye election burden, they pay the taxes..

    Can someone clarify as to how many times a MP, MLA can resign and how many times election are to be held at the expense of the Taxpayer? We vote once in 5 years, and if a MLA , MP is incapacitated, there should not be elections as it involves expense in crores.
    Its a mockery of our system that elected representatives can be made to resign and contest by elections.
    It would be a biggest blunder if the courts sets a disastrous precedence.
    The judges are lead also by their conscience and the law makers are to be held accountable, even if they refuse to enact a law just to favour their mon(k)ey business.

    EC is toothless and a caged parrot. Only Mr.Ashok Lavasa had the guts to question his colleagues for not issuing ban for Modi and amit Sha for violating code of conduct.
    Today I read in the new channel headlines that I.T issued notice to Lavasa's wife. Whomever raises their voice agaisnt this government they're attacked by ED /CBI or I.T.
    This is our democracy and this is the very reason our DC Mr.Senthil resigned.

    E C cannot override Speaker's Judgement, only Supreme Court has the right.
    Disqualification under relevant sections bar the disqualified MLA's from contesting for the period of the present assembly which E C has not read properly or is influenced or pressurized by center to feign ignorance it seems to influence the judgement of Supreme Court.
