Panaji, Jul 15: The Goa Bench of Bombay high court on Tuesday dismissed plea of Central bureau of investigation (CBI) give letter Rogatory to interrogate Fiona Mackeown, mother of deceased Scarlett Eden Keelin and another British witness.
The CBI, after failing to get the letter through Goa Children’s Court, had approached high court with the request, which was turned down by the bench comprising Justice B P Dharmadhikari and Justice U D Salvi.
The bench, however, gave three months extension for CBI to investigate the case, which was reported in February 2008.
British teenager Scarlett’s bruised semi nude corpse was found at Anjuna shore and two locals were arrested for drugging, raping and leaving her to die on the shore.
After initial investigations by local police, the case was handed over to Central Bureau of Investigation.
The CBI earlier had approached the children’s court with the plea for letter Rogatory, which will enable them to interrogate Fiona and Charles Carter, another witness in this case.
President of the Children’s Court Desmond D’Costa rejecting the request letter to CBI had said that the the questionnaires proposed to the witnesses, is almost answered by them in the statements recorded while the case was with Goa police and before it was transferred to CBI.
The CBI under section 166-A of the Code of Criminal Procedure 1973 had prayed to the children’s court to issue the Letter Rogatory for the judicial assistance to conduct further investigation and collect evidence, in UK.
