Beltangady, Oct 4: Bending under constant pressure brought on him by the people of his assembly constituency to punish a forest officer who reportedly accused an innocent man of stealing wood from the forests and mercilessly beat him up although he lives beyond the officer's jurisdiction, the local MLA promised that the guilty official would be shunted out of this region within three days.

The promise came at the end of protest held in front of the forest department office here by various organizations on Tuesday October 3, seeking suspension of Ujire deputy range forest officer, Keertan Shetty, who has been accused of launching murderous assault on Kamaldas from Puduvettu, after accusing the latter of stealing wood from forest.

MLA K Vasant Bangera who came to the spot and met the protesters, noted that the assistant conservator of forests has already conducted department inquiry into the issue and that the divisional forest officer would be submitting the report to chief conservator of forests. He said that the minister has promised to take action against the forest officer before Saturday.

Taluk BJP president, Ranjan G Gowda, JD(S) taluk president, Praveenchandra Jain, district BJP Yuvamorcha president, Harish Punja, zilla panchayat member, Sahul Hamid, Fr Vinay Joseph, Congress rural block president, Srinivas Kini, Youth Congress president, Abhinandan Harish Kumar, Dharmasthala gram panchayat president, Chandan Kamath, Malayalee Christian Association state president, A C Jayaraj, mother of Kamaldas, Mariyamma, wife, Diana, children, Deepsan and Deepsal, and several other leaders and villagers were present.

A memorandum was also submitted to the chief minister and forest minister on this occasion. A procession preceded the protest.

    Heard all political party leaders (JDS /BJP/Cong) including local MLA and a catholic priest was there on protest against this officer, if he is guilty (as per above write up) he should be suspended and booked for assault. Transfer means this man is connected to a live wire?! heading to VIKASA SOUDHA in Bangalore!!

    There are few things in this case that are clearly disturbing:

    - Firstly, Keertan Shetty transgressed on his jurisdiction (this is not disputed by the forest department officers, and hence this charge ought to be considered as true). I am ready to condone this one fact as a pure technical breach;

    - Secondly, Keertan Shetty confines a private citizen to a make shift lock up in his office. This is a clear transgression of a citizen’s fundamental right to freedom & liberty which cannot be snatched away without following the due process of law. Keertan Shetty is an officer of the State and he is duty bound to uphold the protection granted by our constitution. Due process of the law cannot be done away with at whim of an officer;

    - Thirdly, Keertan Shetty uses physical force on a private citizen when he is confined in an illegal arrest. He has no right to use force on an unarmed person.

    It does not matter whether the victim was a smuggler or not; and it does not matter whether Keertan Shetty asked for an illegal gratification or not. The fact is that the second and third matter noted above are very serious breach of the law and criminal charges ought to be laid against him for those breaches.

    But alas, the unwritten code that prevails among all these public officials are such that everyone tries to save the back of their own breed. If the second and third point does not warrant a dismissal from service, then I really fail to understand as to what else is the department expecting him to do get booted out. I wonder if the victim had died of torture, would they have still held on to his service?

    He should not have acted in such a furious manner. For every offence there isa procedure which the forest officers and any officers should follow.

    What's the use? He will go to some other range and trouble innocent there. Transfer him to such a department where he cannot harm innocents.

    Why transfer? Why not dismissal from service and an FIR for causing bodily harm?
