Mangaluru, Sep 14: City mayor, Kavita Sanil, appeared before the state high court (HC) on Wednesday September 13 relating to a writ petition filed there. Owner of Green Valley Unisex Saloon Centre on Balmatta Road in the city had, through this writ petition, questioned the surprise raid and locking of the centre by the mayor.

The single judge bench of the HC presided over by Justice Vineet Kothari, which conducted hearing into the writ petition on Wednesday, passed the above order. During the hearing, the mayor filed an affidavit.

After hearing arguments and counter arguments in the case, the bench asked the mayor and city corporation commissioner to properly scrutinize complaints of violation of legal requirements, rules and procedures by the petitioner in running the salon before taking steps. It said that rules, procedures etc needed to be followed before conducting such raids have to be complied with.

On the allegation that illegal activities were going on at the said centre, the city mayor, accompanied by a team of officials, had raided Green Valley Unisex Salon Centre on July 11 this year and locked up the concern. Owner of the salon, Francis Kiran Lasrado, and manager, Vinoda, had approached high court against this action through a writ petition. The bench, which had earlier heard the petition had issued interim order permitting the owner to run the unit.

    I feel this mayor who lacks legal knowledge was acting at the behest of people envious of success of the beauty parlor.
    Beauty parlor can still file for damages against this mayor.
    Although it looks like she was acting on her own for a good reason, her motive seems to be so much dubious too.

    Just imagine, how can H.C. say this?

    She did not rid alone, she went with the related Authorities.
    How you can stop illegal activities if you inform them first by serving a notice,
    saying that " We are going to raid you Saloon, beware...ha...ha..."

    May be HC wants this way,

    Hi guys , i am coming with Police Authorities & Municipality officials to raid you saloon to stop illegal activities, so clear up every thing before I come.

    Raiding is along with proof and law officials. A raid is to be documented with evidence to stand up in court and there are designated agencies for it.
    As a mayor there are issues what a mayor should be doing like our public transport, roads and so on, whats become of those responsibilities?

    Mayor is an elected representative and not a magistrate like D.C. or A.C. Even MLAs and MPs have to act through the district administration and cannot conduct raids, but their premises may be raided by the authorities with sufficient cause. The final decision vests with the Courts of Justice.

    @Jossey S.Mumbai,I think before anyone raids a shop or spot ,a written and signed permission of a court is necessary everywhere in the world.Just one cant enter someones house or workplace and close it because you are a .....First permission about doubt and needed fotos or so and then with assistance of police raid a shop showing the permission.It is not a fish market and going to buy fish.HC was in correct verdict.

    Mayor can not be the judge.
    The right way could have been, the Mayor could have coordinated with the police, raised a complaint with the police and requested for joint surprise visit. During the visit the immediate evidences for illegal activities could have been collected to frame a strong case.
    Police could have arrested the owner and produced to the court. It is the courts who decide to lock down the parlour and not the Mayor.

When the shop owner itself says that they are paying regularly the haftha to police , how to belive the police then ? . Here in India what ever like this has to be done they need to inform. Like raiding any shop they need to inform , Surgical strick they should show the video , note ban they should hv informed . If everything like this is informed then how to catch the culprits .

    Intention or purpose and legality does not go hand in hand. Mayor's intention might have been good but legal rules needs to be followed. Legal rules needs to be changed in cases where the very purpose of administration gets defeated while following the rules.

    The way forward for honest, strict, law-abiding Officials & Administrators in India, is really tough and daunting. There are simply too many procedures and precautions to be followed, due to which quick and strict implementation of the law for curbing illegalities is very often not only cumbersome, but difficult to implement in a fast & effective manner.

    The way to go about things in future would be, to simplify the administrative procedures of search & seizure, and to make law-breaking (for businesses & establishments) a very costly proposition (involving huge penalties & arrest of wrong-doers). Then only, would we able to have a highly effective, less cumbersome administrative machinery and an end to red-tapism and corruption.

    Court can take time to study the case in detail and i am sure they will be fair in the judegment . The issue is if there is something illegal and there is evidence first hand information immediate actoion should be taken . This is what Mayor has done nothing wrong
