BJP notice to Ramachandra Guha for linking Gauri murder with Sangh Parivar


Bengaluru, Sep 11 (Agencies): The Karnataka BJP Yuva Morcha's secretary on Monday issued legal notice to historian Ramachandra Guha over his statement on murder of senior journalist and social activist Gauri Lankesh.

The notice comes after Guha in an interview to Scroll.in the day after Lankesh was killed, said, "It is very likely that her (Gauri Lankesh’s) murderers came from the same Sangh Parivar from which the murderers of Pansare, Dabholkar and Kalburgi came."

He went on to say, "The ruling dispensation in Delhi has created a climate of hate and intolerance."

The historian made a similar statement to The Indian Express newspaper where he said, "The climate of hate and intolerance that has been promoted by this current (BJP) government, aided by television channels and freelance goondas, is complicit in this murder. It is chilling. We are becoming mirror images of Bangladesh and Pakistan, where writers are killed for what they say. This is an attempt to silence all of us, all of those who believe in democracy and decency."

Reacting to the notice, Guha tweeted: "Atal Bihari Vajpayee said the answer to a book or article can only be another book or article. But we no longer live in Vajpayee's India."

In another tweet, he said, "In India today, independent writers and journalists are harassed, persecuted, and even killed. But we shall not be silenced."

Senior journalist and social activist Gauri Lankesh was murdered outside her Bengaluru residence last Tuesday. Seven bullets were fired at the senior journalist, when she was about to enter her Bengaluru house. Three bullets hit her – two in her chest and one in the forehead.

    Dont express things/matters on doubtful way. its a great sin to do such a thing. But BJP also does the same thing in many cases without knowing the facts of some cases. So notices have to be issued to them also.Why one sided action?

    My brother D'Souza, just to enlighten your knowledge, please note the following:

    1. Defamation cases are not taken up by courts or police suo-motto. Whoever is the aggrieved party, they could approach the judiciary with a compliant. Not just BJP, rather every other political party in India makes scandalous and sensational accusations every now and then. Any person or party who feel that their reputation has been defamed are free to approach the judiciary to redress their grievance.

    2. Accusation of corruption / malpractice / inefficiency / ineffectiveness made against the Government inside the parliament / assembly is immune from prosecution under our constitutional set up.

    So in short, if you are aggrieved by accusations made by some BJP leader, you are free to approach the judiciary. Please do not expect some one else to take up your case to satisfy your ego.

    When Gauri was convicted for writing nonsense on them, Sangha Pariwar took up the matter and ensured Gauri is convicted by the court.

    However Gauri did not mend her ways.

    I am now confused, what will be the next course of action in a democratic way? Certainly killing is banned in democracy and no one should think it is next option.

    By serving notice BJP wanted to silence one more intellectual using administrative power.
    This is same reason Gauri Lankesh, Dabholkar and Pansare were murdered.

    If BJP believes in justice system then it should have asked the journalist to respect the investigations.
    But serving notice he became one more target of the right wing.

    If they said person has proof let him help the police

    Sorry Mr. SMR, but Mr. Guha was not born with an inherent right to defame any organisation that is still a lawful organisation.

    Mr. Guha may have deep rooted suspicion about the involvement of RSS in the murder and it may very well be true at the end. However, as of now, there is absolutely no evidence to link the two. Suspicion, however grave it may be, cannot be a substitute for evidence to prove a crime.

    Mr. Guha has made the claim; so he better back it up with some reasonable evidence. If he does not have any such evidence, it means he is merely throwing the dice in thin air and hoping that it hits the bird. That is not evidence, it is called defamation.

    Sir, the so called 'social organisation' RSS was banned thrice in the past. It would have been listed terror organisation if Mumbai attacks didn't happens and brave officer who exposed saffron terror was not martyred.
    Mr.Guha is just repeating the same words Gauri Lankesh before her death expressed it.

    Gauri Lankesh is one person murdered. But now there are more murders emerging in all form supporting the terror act.

    Instead of condemning the henious crime her death has been celebrated.

    Instead of notice by BJP to Ramchandra Guha, the notice must have been given by the investigating agency and after findings - both the parties should be given opportunity to initiate legal recourse.
