Mangaluru: Elderly couple in quandary after house turns out to be on non-transferable land

Mangaluru, Aug 16: In an eye-opening incident, an elderly couple living at Suratkal from the part 47 years, is on the verge of losing land and house, chiefly due to lack of awareness on government laws.

Felix and Stella Coelho are in a fix at the moment. The couple had earlier owned a land and a house at Panambur, but lost both after the government acquired the same for New Mangaluru Port Trust. After knocking at every door and asking for help, their continued efforts to avail compensation or alternative land ended nowhere.


Land at Suratkal

The couple gave up hopes of receiving compensation from the government and spent all their savings to purchase a 38-cent land at Suratkal. The land was purchased by the couple from a third party.

But some months ago, the couple received an order from the government pertaining to Karnataka Scheduled Castes and Scheduled Tribes Act, 1978. The couple ran into trouble again as the land they had purchased from the third party, came under the Prohibition of Transfer of Certain Lands (PTCL Act).

According to the Act, transfer of certain lands granted by the government to persons belonging to the scheduled castes and scheduled tribes in the state, is prohibited. Such property will be eventually acquired by the government and returned to the original owner without any compensation to the purchaser.


Court battle

After seeking suggestions from the few people they knew, the couple decided to approach the court. They informed the court that they came to know about PTCL Act only after they received the notice from the government. They also told the court that the third party had not informed them about it.

After spending a huge amount of money on the case, the couple lost the battle. The fifth additional sessions court upheld the PTCL Act and issued an order to hand over their land to the first party.


Deputy commissioner’s order to vacate

The deputy commissioner, on April 24, 2017, issued a notice to Stella Coelho saying that she had illegally occupied the 38-cent land which comes under survey number 247/4E Suratkal village.

The couple spent nearly three months in the same house living in fear of being evicted. On Wednesday August 16, the assistant commissioner and the land surveyor visited Stella’s house along with the other party, the actual land owner according to the court.

The assistant commissioner took a written statement from both the parties. Stella informed the assistant commissioner that she had received the notice from the DC to vacate the house, but not from the court.


"Where should we go?"

Speaking to Daijiworld Stella said, "We accept the court's verdict and we are ready to leave this land. We have no intention of disobeying the court's order. But where can we go at this age? My husband is suffering from acute diabetes and high blood pressure. He cannot even stand for a few minutes. We have three daughters who are married. We cannot purchase land and build a house at this age. Therefore, we request the government to let us live in this piece of land till we die. If not, please give us an alternative solution. Please consider our age. Otherwise, we will be forced to live in bus stands and streets."

Gopal, the owner of the land said, "I am residing at a rented house. This land was granted to my father as per the PTCL Act. Now I want to build a house on this land. I cannot get any other land as according to records, my father has already claimed land from the government. I have my mother and brothers and we are living together. I will never use this land for commercial purpose."

After the visit to the elderly couple’s house, assistant commissioner Renuka Prasad said, “It is an order from the court and we are acting accordingly. If the couple has not received the court order, they can apply for one through RTI. They will have the right to appeal in higher courts once they have the court order’s copy. We cannot evacuate the couple now as we will have to proceed as per law. I will submit the statement of both the parties to the concerned authorities and will follow the proceedings."

    Supreme Court Order 2017 related to Grant land.

    If restoration of Grant land is made after an unreasonably long period( 20 years and more) it is liable to be dismissed on that ground.

    Therefore, an application can be made at any time by the original grant land heirs are overruled.

    I think this rule will help the elderly couple to regain there land.

    Senior citizens who lived in this house for past 47 years who paid and bought property now just like that leave and go what a shocking for them.

    Feel very pity for the elderly helpless couple. It is clear that they paid money to get the land. It is also clear that the third party seller and subregistrar have cheated them. The cheaters and the Government should compensate for the unfortunate senior citizens.

    After 47 years, Imagine our Indian Government awakens to alert this old couple !!!! I am sure there is some foul play........... as a known fact in India property matters are always dirty and our so called government just has a book of rules which they themselves are challenged knowing wht comply's.

    I support this couple and hope that there is some solution in favor of the old couple.

    there is absolute no need to discuss about their daughters and what are they doing and are they taking care or not ... THE QUESTION IS TO PROTECT THIS COUPLE AND SAVE THEIR HOUSE WHICH IS THEIR DWELLING and understanding that they are at the close end of their lifes journey ... we as responsible citizens should voice and let the govt know not everything has this pen n book rule and they cud be wrong too !

    Those couples lived there more than 40years ,how can they say them to leave their house..If it is their(SC/ST) land then they should be punished for selling that land.. if they don't want to be a prisoner then they have to leave those elderly couples to stay there or government have to pay for all problems they have created for those elderly couples..and those couples are uneducated..even a educated person will suffer because of these land problems..as the above pictures shows that those elderly couples are so weak and disable...so according to me those elderly couples should be allowed to stay there for rest of their life

    Why the court/or any Govt. Dept. only look at the last page of property documents:? They need to question the parties involved in this land prior to the purchase by this Old couple. They are old and now these authorities ready to do injustice to them? Why were they not paid for the land taken away from them? Is this justice? My request to the Authorities, please read the documents again and again and find the fault at the right place with right people. Its more work but you are able to do the justice to right person and arrest the wrong one. Also there are many better things to do for the people who have voted you because of your promises. Please work on them and let this couple live in peace. Also please find ways if you can help them in their daily bread. God bless you.

    In land dealings, carelessness and purposeful omissions are made by the government officers. They purposely try and twist survey numbers, names, addresses, dates and so on for the purpose of corruption. Corruption is highest in the matters and offices of land dealings. Even the lawyers play their game and the cases twist and turn. No conscience only corruption. Land matters are becoming verse and verse. Officials be truthful and upright in your dealings and duty.     in india law relating to land is so complicated that even a well educated person also might get confused while buying any land, and taluk panchayath, and palike staff are so arrogant, they don't even give full information to general public.

    Felt very bad when i heard this , i knew them from 30 years. The only and best idly /aapa makers in Thadambail of 90s and 00's , they never had fights or any disputes with anyone. Govt should re verify the plot again and do some favor considering their age and their health conditions. Need to appreciate thadambail fellows who supported them regardless of religion. Thank you.     Rathan i agree with u. As a humanity, who cheated by from 3rd party is old couples. At this age asking them to get outis not right. Either compromise other party demananding 3cents each an 8 of people of them give that an allow old couples to stay that house legal way.

    The root cause of the problem and the culprit is the sub registrar office who registered this piece of land on their name. At the time of registration , why the sub registrar office didn't inform the couple that this land comes under PTCL act. Hence cannot be purchased or registered. How the common man knows all these laws and details of the land? Only the concerned government officers can educate the purchaser while buying/selling the land.

    There are lot of missing linkage /coordination of sharing the land information between inter government offices like sub registrar office, urban develop authority, municipalities. Because of these a common man is facing lot of problems. This needs to be sorted out.

    You are right. The common man does not understand the legal implications of land purchase and sale, and should not venture to buy and sell without legal help. The question here is was a lawyer employed by this couple to act in the transfer, and was there a lawyer representing the seller of the non-transferable land. If no to both points, then the blame should also fall on the couple. If any one had represented the couple, that person did not do the elementary homework to ensure that the seller had the right to sell, and is negligent for that reason and hence liable. There might be some fraud involved, or collusion between lawyers if seller too had a lawyer, and then it becomes criminal.

    Here catch the person who registered it and who sold it! There r 3 daughter s why they can't look after them? Government should impose heavy fine and imprisonment to those who don't take care of their parents. In Kuwait I don't see any old age homes. All aged parents are looked after by their children.

    How come on earth, if it is coming under PTCL act, How did the concerned government official sell this piece of land to this elderly couple????? They did not follow rule???

    If he could sell this land from a third party, government official did not do his duty diligently. He becomes responsible for this entire episode and he should refund the entire amount to these elderly.

    Alternatively the owner can allow them to stay till their life or provide
    them a shelter as there is vacant land and community ppl can help to build a small shelter

    Largest frauds happening on earth are in earth. With connivance of babus, the cheaters are able to sell properties which belong to others. Many gulf people have lost such plots in Bangalore and Goa, since after registering, they are busy on their jobs and after some years they find houses on their plots, and people living. Good example is the film "Khosla ka Ghosla" on this type of cheating.
    Today, in India, lakhs of people specially senior citizens are not getting their capital and interest on fixed deposits with many companies . Hence, when you take every step on investment, beware.

    Very bad situation.Is like falling from hot pan into burning coals.Someone must help these couple.First ask for the money ,which they paid for buying that land.,house.Fellow didnt give them for umme.Second let them ask the compansation of their land in panamboor ,from Govt.why did they not get ,when all others got?They should take a good lawyer to claim it.Hope they get help.

    I would like to add one more point to my comment sent earlier today. There may also be another person involved who was retained by either the seller or the buyer to put through the transfer of the land - generally the lawyer. If it is Coelho's lawyer, there is negligence, failure of duty of care, and if it is the seller's lawyer, he bears the greater liability - based on fraud..... perhaps both lawyers are dead!

    In any case, it is a fit and just case for the government to grant ex gratia compensation.

    What surprises me that if the land was not transferable then how come the land was registered in their name. Who is responsible the purchaser or the seller or the govt. The govt should have been aware of it before registering it. Will the govt refund the purchase price and even the registration charges plus other bribes involved in it including lawyer's fees. It is the system in India that kills an human being.

    Not only minorities, no one can buy land notified under PTC. It is truly sad that we have a system which allows for such transfer and cause hardships to buyer. I feel bad for the couple who are stuck. Same is the case with purchase of agriculture land by non Farmers. Land will also go, money will also go. Our system needs reform.
