Bengaluru: Bhaskar Shetty murder case - HC refuses bail for Niranjan Bhat

Bengaluru, Jul 27: The third accused in the sensational Bhaskar Shetty case, Niranjan Bhat, has been rejected bail by the High Court here on Wednesday, July 26.

The single bench court, presided by Justice Ratnakala, asked Bhat to provide evidence relating to the case to the prosecution in the next 6 months and to apply for fresh bail in the competent court.

The advocate for Niranjan argued that the accused was not involved in the murder directly as per the chargesheet and other two accused are on bail. He promised that Niranjan will cooperate in the case if he is given bail.

Additional advocate general A S Ponnappa who argued on behalf of the State, said that Niranjan was involved in the murder directly and had also tried suicide attempt in jail. He also said that there is evidence to show that Niranjan threatened Bhaskar Shetty by showing pistol with the help of his friend from Mumbai. “It is also known that the dead body of Bhaskar Shetty was burnt to ashes in a Homa Kunda in which Niranjan Bhat was involved. So if let on bail, Niranjan Bhat has the chances of destroying evidence. So he should not be granted bail.” Ponnappa argued.

The Bhaskar Shetty murder case is one year old now. Rajeshwari Shetty, wife of Bhaskar Shetty, her son Navaneet Shetty, astrologer Niranjan Bhat, his father and assistant were arrested relating to the case. While the first three are in jail, the other two are out on bail.

    You say that you do not practice any religion and do not give a damn about any religion. And that is exactly why you call yourself Abdul Narayan D'Souza. Then, why your name is Abdul Narayan D'Souza?

    Name 'Abdul' belongs to Muslim religion; so as 'Narayan' is belonging to Hindu religion and you know very well that 'D'Souza' belongs to ......

    Firstly, I choose whatever the name I want to be addressed as; I do not have to justify my name either to you or your ego.
    Secondly, is there any restriction on the use of any of words Abdul/Narayan/D'Souza by a non-religious person? Does Islam, Hinduism and Christianity have a copyright over these three words? Could you please enlighten me?

    I can just pity your medieval thinking where death penalty seems to be solution to every problem in society. Do you even know what death penalty stands for? Would you personally even have the courage to pull that lever on execution day?
    The IS and Taliban applied death penalty to virtually every ‘crime’ that did not satisfy their masters bloated egos. Are you prepared to live in a society governed by the laws of IS/Taliban?
    Iran, Saudi and China conduct the most number of executions; whereas Europe, Australia, Canada and NZ do not have death penalty. Then why isn’t Iran/Saudi/China a shining example of crime free world? Why do cities in Europe, Aus, NZ and Canada rank very high on most liveable places year after year?
    The judges sitting in India’s Supreme Court are not idiots. The death penalty exists in Indian penal code since the British era. Hence in order to bring India’s judicial pronouncement in line with the 21st century mindset, they coined the term “rarest of rare” cases in application of death penalty. One way or the other, the country’s highest court has always tried to see if a condemned prisoner’s life could be spared. Hence this is the reason why only 4 persons have actually been executed in the last 20 years; and this is the reason why the killers of Rajiv Gandhi, the killers of Beant Singh and Veerappan’s associate are still alive in prison.

    Court may not come to conclusion sometimes just because lack of proof and documents to convict the culprit. But ultimately GOD is there and he saw everything invisibly!!! Definitely Justice will be done by his own court!!!

    Yo Jossey..... please read Article 20(3) of the Indian constitution - "No person accused of any offence shall be compelled to be a witness against himself". Whether you like it or not, every accused person in India has a constitutional guaranteed right to refuse testifying against his own criminal action. [And just to clarify. The constitutional guaranteed rights apply even when someone is in prison].

    This forms the very core of criminal jurisprudence in almost every developed country in the world because it is presumed that the accused is innocent unless proven otherwise. And this burden of proof is on the prosecuting agency. The accused does not have to prove that he is innocent just because he has been charged so by the state.

    So coming back to your point – whether they tell the truth or not, they cannot be held in prison indefinitely.

    Thank you for showing our constitutional law.... India is a country and they made law according to religion also.... Court will be confused to give any judgement if you are convicted. Judge will think you are Hindu becasue your name is Narayan again he will be confused may be you are muslim or may be again he will think you are D'souza.

    Sorry to inform you my friend, but criminal code in India (i.e. mainly IPC and CrPC) does not distinguish between a Hindu, Muslim and Christian. Criminal code is uniform to everyone. Only a separate civil code exists for various religion. So if I am ever convicted, the judge doesn't have to worry about my religion. And most importantly it is none of his business.
    I do not practice any religion; and I do not give a damn about any religion. And that is exactly why I call myself Abdul Narayan D'Souza. Otherwise most of them interpret any comment using the spectacle of religion.

    If all the 3 major culprits are not convicted particularly in this dreaded case, certainly, but surely - we all the Udupi/Mangaloreans loose faith in jurisdiction. however, we are sure and have faith in Indian Jurisdiction. AS THIS CASE WILL BE A LESSON TO ALL THE PEOPLE - CRIME NEVER PAYS.......
