Bengaluru: HC refuses to stay suspension of BBMP assistant engineer

Bengaluru, Aug 25: The state high court (HC) has refused to issue stay order against the suspension of Bruhat Bengaluru Mahanagara Palike (BBMP) assistant engineer of Rajarajeshwarinagara zone, M V Guruprasad, from service. The suspension order was issued by the BBMP commissioner for failure to stop encroachment of lake and main canals.

The application filed by Guruprasad seeking to stay the suspension order came up for hearing before the single judge bench of the HC presided over by Justice B S Patil. The bench refused to stay the suspension but put off hearing for ten days after instructing BBMP to file objections if any about the said application.

Guruprasad was one of the 20 officers against whom action was taken for sanctioning of house plans which included encroachment of land belonging to main canals and lakes.

Guruprasad had said in his application that he was suspended for misconduct and dereliction of duty charges. He said that the BBMP commissioner does not have power to suspend him from service. He also argued that the allegations against him cannot be considered as misconduct and dereliction of duty. Therefore, he had sought dismissal of the order and stay order against this suspension till the application is disposed off.
