Udupi, Jun 4: The court here has passed an order instructing the owner of the truck and insurance company concerned, to pay a compensation of Rs 40.35 lac along with interest at eight percent per annum till date of disbursement. The court passed judgment on these lines in connection with the death of Syed Noorulla from Kaup, who had died in an accident which occurred near Sharavati Circle in Honnavar, Uttara Kannada district, four years ago.
At around 5.30 am on May 20, 2011, Noorulla, who was travelling in a bus, was standing behind a Mumbai-Mangaluru bus operated by Mangala Travels, which had been stopped near Sharavati Circle in Honnavar for enabling some passengers to alight. Noorulla, who was watching other passengers removing their luggage, was knocked down by a truck which came from behind and hit the bus. Four persons including Syed had lost their lives in this tragedy.
The family of Syed had filed compensation claim through the court of the civil judge (senior division) and additional motor accidents claims tribunal. The court, which heard the case, came to the conclusion that the accident could be attributed to the recklessness of the truck driver as claimed by the litigants. Therefore, owner of the truck, and the insurance company, Bajaj Allianz General Insurance, have been ordered to pay a compensation of Rs 40.35 lac to the family of the deceased, along with interest at eight percent per annum from August 27, 2011 till date of payment.
Judge of the court of the civil judge (senior division) here, K A Nagajyothi, passed this order. Young advocates, Asadulla Katapadi and Rajesh A R, had argued the case on behalf of Syed Noorulla's family.
