Bengaluru: Vatican 'suspends' priest accused but acquitted of rape charge

Bengaluru, Jan 12: In perhaps the first incident of its kind in the history of the Archdiocese of Bangalore and probably even in Karnataka, the Vatican has suspended a priest, who was accused and tried in the court of "forcibly raping" an young college going girl in Tumakuru.

The priest, however, was acquitted by the court of the charge as all the witnesses including the girl, her parents, grandmother and others had turned hostile.

According to information independently confirmed by Daijiworld after contacting several authoritative sources in the Archdiocese, Congregation forthe Doctrine of the Faith, which is the highest body in the Roman Curia, has officially communicated to the Archbishop of Bangalore Dr Bernard Moras last week regarding its decision of suspending the exercise of "the priestly ministry in public" of Fr Simon Bartholomeo with immediate effect.

The Archbishop, when contacted by Daijiworld, declined to either confirm or deny the decision on suspension of the priest and merely said: "I am not at liberty to disclose any information on the issue. You have to speak to the person concerned (Fr Bartholomeo)."

However, it is reliably learnt that the Archbishop has divulged the contents of the communication from the Vatican’s Congregation for the Doctrine of the Faith to the members of the Archdiocesan College of Consultors.

The members of the College of Consultors of the Archdiocese of Bangalore are: The two Vicar Generals Msgr S Jayanathan, Msgr C Francis, Episcopal Vicar for Religious Fr Xavier E Manavath, CMF, Fr Mathew Koikara, cmi, Fr Edward David, Fr A S Anthony Swamy, Fr Joseph Menezes, Fr Mariappa Gregory, Fr Vincent Maria Gregory and Fr L Arulappa.

According to some of the members of the College of Consultors, who were contacted by Daijiworld, the order from the Vatican’s Congregation for the Doctrine of Faith pertaining to Fr Bartholomeo cannot be strictly termed as a "suspension." However, it specifically bars the person from "exercising priestly ministry in public" and as such he cannot function as a priest.
Vatican’s decision on virtually "suspending" the priest, Fr Bartholomeo, was communicated to the Archbishop of Bangalore by Vatican’s Apostolic Nuncio to India in Delhi, according to a member of the College of Consultors.

The Congregation for the Doctrine of Faith had taken the decision to bar Fr Bartholomeo from "exercising the priestly ministry in public" followed an inquiry conducted by the Metropolitan Diocese of Bombay. "Any decision on revocation or withdrawal of the order will have to be taken only after the Metropolitan Diocese of Bombay submits its report to the Congregation for the Doctrine of the Faith in Rome," said a member of the College of Consultors.

Inquiries by Daijiworld revealed that Vatican had asked the Archbishop of Bangalore to conduct the inquiry as complaints against Fr Bartholomeo had been directly forwarded by several persons and organisations. But the Archbishop had reportedly declined to get involved in the issue on account of the agitations by some of the Kannada priests against him. Consequently, Vatican entrusted the task of conducting the inquiry to the Metropolitan Diocese of Bombay.

Fr Bartholomeo was appointed as the Parish Priest of St Rita’s Church in Kunigal Town in Tumakuru in the year 2004. He had reportedly close and intimate relations with a young 19-year-old college going girl, who was also getting training in operating computers. As the girl was a commerce student, the priest reportedly offered part-time job of handling the church accounts. The friendship between the girl and priest turned intimate allegedly leading to sexual relations from 2005 onwards and girl reportedly got pregnant and was allegedly helped by the priest to undergo abortion or medical termination of pregnancy at a private nursing home in Bangalore in the year 2006.

The girl and her parents lodged a complaint with the Kunigal police in the year 2008 and the case was tried in the court of the Second Additional District and Sessions Judge of Tumakuru. The priest, however, was acquitted by the court as all the prosecution witnesses including the girl, her parents, teachers and others had turned "hostile."

Fr Bartholomeo had been transferred as the Parish Priest of Our Lady of Fathima Church at Jalahalli in Bangalore last year. The posting of Fr Bartholomeo as the Parish Priest of the Our Lady of Fathima Church from Tumakuru led to strong protest by the local people.

Incidentally, Fr Bartholomeo is one of the key leaders of the Kannada Catholic Priests Association, and according to the police sources is believed to be very close to Fr William Patrick, one of the two priests along with a lay accomplice arrested in the sensational case of the murder of Fr K J Thomas, the then Rector of the St Peter’s Pontifical Seminary in Bangalore on the small hours of March 31-April 1, 2013.

It is learnt that Vatican is seized of several complaints against many of the other priests, especially those involved in the fight against the Archdiocese on the language issue. The pro-Kannada priests as well as pro-Tamil priests and many other lay associations have also reportedly sent several complaints against the Archbishop and pro-Kannada priests.

    Yes - The Pope is the Vicar of Christ. Our ancestors, the current and the future generation are prone to sin and evil. For God to be merciful, he must also be just and our acts of sin and evil deserve punishment and eternal loss of our souls. Yet God looks with kindness and love on his creation and brings about wonderful acts of virtue and offers us eternal life. God is not to be mocked and people need to repent and learn humility. Finger pointing will not serve us well as ALL of us have to answer for each sin and wicked deed we have committed to the holy, eternal and just God. How will you face God - have you pondered on that and does it even matter?

    It is shocking.Already, two priests are accused of murder of Rev Fr K J Thomas (refer K J THOMAS profile on Facebook ) and now this one from this notorious Association.Is there some more skeletons waiting to be unearthed?...It is obvious that piggyback the language and get away doing whatever you like no matter what disgrace that can be wrought upon the community and Almighty.I am sure, the community at Jalahalli had every right to protest.We hear the dubious methods adopted by this priest to subvert the voice of the people and this 'suspension' is come really to logical end. Interestingly,we should find out who helped (with OUR money)to buy silence from the victim and turn 'hostile' at the court of law.If firm stand had taken by the then authorities supporting and securing protection to the victim it would have been natural justice.Such stand would have stopped these at their tracks and many misdeeds could have been averted. Well done Vatican

    @ Kurt waschnig , anp , declan. All cases are not child abuse , some are consented though considering celibacy its morally wrong. Age of consent vary with countries and UN definition of 18 does not apply everywhere. Spain and Angola has age of consent as 12 to 13 , even Vatican had age of consent as 12 till recently. Cannon law sets it as 14 for girls , besides some religious personal laws set it as age of puberty and by default it becomes age of majority. Eg : Iran ( 10 plus) , most Latin countries ( 12 plus ).

    And desides anything lower than this is certainly a Child Abuse and only state laws can prevent it not religious cannon laws.

    This is an isolated case of an individual catholic priest. Nevertheless Vatican needs to be congratulated for this bold step. Since every Bishop has detractors within his diocese amongst Priests and finds it difficult to take action against an erring Priest, it is suggested that Vatican constitute an "All India Catholic Church Jury" comprising of Bishops/Canonists from various dioceses to probe such matters in any diocese. The Bishops could refer the case to such a Jury which will directly report to the Vatican and obtain the strictures from Rome on continuity with the Priestly Ministry. This will safeguard the Bishop and the image of the diocese and the Catholic Church.

    Vatican has taken a commendable decision, which will have long run effects on the attitude of many of our Priests. Vatican is moving in the right way. We the layman request the priest to keep your values very high instead of dividing the congregation. You are closely followed by us. Be a good example. As far as the suspended priest , we need to forgive him and pray for him and his family. He is still a faithful.
    The Metropolitan Diocese of Bombay has taken this task of enquiry and reporting to Roman Curia. What it means is our Bangalore Archdiocese cannot handle these cases, and shying away from reality. We need a branch of “ The Congregation for the Doctrine of Faith” in Bangalore having members nominated by Pope. Members be our own priest who are living saints having clean record. We have many such living saints. I will definitely say that you will get flooded with many such complaints. And we can cleanse our system. This is a humble request to Our Nuncio in New Delhi , The Metropolitan Diocese of Bombay and Bangalore Archdiocese.

    There is a difference! The Priest is a disciple of Christ and an Alter Christus. Unfortunately, the world we live in is bombarded daily with sexual materials (books, images, etc.) and no effort has come from the public and the political leaders to denounce these sexual materials and remove them from society. Our youth and adults are growing up in a society with laxity towards sin. Christ has forewarned the consequences of living in sin and we need to pray for the priest, the girl, her parents, grandmother and many countless people who are falling into the trap laid by satan.

    I salute all the priests who have sacrificed their whole life to serve the community-like, building churches, schools, hospitals, home for the aged and orphanages, vocational training centres etc..
    Just like any of us the Priest too is a human and may fall into sin.
    It does not mean that all priests are bad and corrupt in their minds.. My sincere prayers to all the Priests that the Lord may guide you and empower you to do the right thing always..
    I truly appreciate our Pope Francis for taking this decision.

    I do not know if Daijiworld will publish my lengthy comment. Clerical child abuse is a dark chapter but it belongs to the recent history of the Catholic Church. It is a fact that ten of thousands of children were abused and raped by Catholic priests and members od religious orders all over the world and there was a systematic cover up of clerical child abuse in many dioceses. Meanwhile necessary steps have been taken and implemented to stop clerical child abuse. In 2014 the United Nations watchdog for children´s right slammed the Vatican for “systematically” adopting policies allowing priests to sexually abuse thousands of children, in A REPORT which also urged the Holy See to review its legislation to bring it in line with international conventions. The UN Committee on the Rights of the Child considers the Church before a secular levels. The report makes no less than to expose the double standards of the Church. It shows point by point how the Church failed to protect the vulnerable and entrenched themselves behind to justify beliefs. It is very shameful for the Church when one reads, “The Committee is concerned that the Church has always made the reputation of the Church and the interests of the offender on the protection of children in dealing with sexual abuse.”

    And the UN criticizes the Church´s negligence in dealing with the perpetrators. They have been protected by internal transfers or were even transferred abroad. And the report noted that families whose children were abused in Catholic institutions have been intimidated by religious authorities. The desired objective was to intimidate the victims and their families. Instead, the victim should be encouraged and supported. If the Church really wants to protect children then the Holy See should open its files on members of the clergy who had “concealed their crimes” so that they could be held accountable by the authorities. The report mentions, as already said above, “the practice of offenders mobility”, referring to the transfer of child abusers from parish to parish within countries. This practice placed children in many countries at high risk of sexual abuse. The world must express gratitude for this excellent report. Children are the weakest members of every society and they have the right to grow up in a peaceful and stable environment.

    Appreciate the trouble you've taken to write such a lengthy comment. There is truth in them. Not only have there been many reported cases of child sexual abuse by some members of the clergy but there have also been cases where some clergy members have fathered a child with a woman.
    Worst of all are the attempts by some of those in positions of authority in the Church to cover up these scandals and intimidate the victims instead of taken corrective action against the erring priests.
    We have read reports that Pope Francis has taken this matter seriously and is making serious efforts to clean the clergy of such members. We know he has a very hard task ahead of him with many in the clergy still indulging in the 'cover up' act.
    As a Christian and a Roman Catholic I hang my head in shame and pray that the Almighty bless Pope Francis and his team with the courage and endurance to clean the clergy of such members and send a loud and clear message to the faithful as well as non-Christians that the Church administration and the Vatican has no place for 'such' sinners.
    We pray and hope that the Church administration sincerely apologize to such victims of sexual abuse and to the children fathered by Priests and sponsor their rehabilitation in an appropriate way to help them deal with their mental trauma.
    All these matters have not lessened our faith in any way as we understand that clergy members are human after all. We understand how tough the duty of a Priest can be and the huge sacrifices they make devoting their entire lives to the service of God and mankind but we pray that they always maintain high moral standards as called for by their vocation. We also know there are hundreds of exemplary Priests and Nuns out there doing God's work untiringly. We pray God bless all of them to carry on his work.

    Priests are called to be holy. After all they are human. He has to Pray to the Holy spirit to guide him not to do such things. Temptation is there always but but can be overcome with the help of the Holy Spirit.If one repents the misdeeds and become aware of the fact that he is the priest he cannot do such things. Forgive and give a chance so that he will not do it again.

    Well done by Vatican. If the priest is indeed guilty of the crime then the Vatican's decision to suspend him from performing priestly duties is commendable. Its is high time someone cleaned the system.

    There are many more rotten priests like Simon Bartholomeo in every diocese including Mumbai, Chennai,Mysore, Mangalore etc.Dont call them Father.They are wolves in disguise of sheep.Most of the Catholic Priests lead a very luxurious life.They go to US, Europe or Gulf for holidays.Most of them have personal cars.Many of the young catholic priests enjoy their life to the maximum.God has given us a Holy Pope. But our priests destroy our church.They are interested in building churches, shrines and making money.No transparency.Nobody can question them.Still they beg for money. Its shameless.     Its all in how people take their religion and follow it. No religion is bad it is its people /followers who spoil it.

    I had read a wording the Pope had said some time back - NO need to be religious to be good, there is no need to visit the worship place also. Its a persons deeds which makes him good or bad.     This is only a tip of the ice berg.Lot of such cases go unnoticed/ignored/unreported.Every religion teachers/gurus have this problem.I have seen lot of comments mocking at persons when reportes of this kind surfaced in this forum relating to Hindus faith.Mjority comments were from non hindus.They exhibit their english knowledge putting best of best words to mock.Interestingly same persons now remain to hide in the rat holes(populor word they inveted)Guys look at the world with single view before hurting others/mud sliding on other faiths.Guddege gudde adda unto maarayare!!!

    Well done Vatican. I appreciate the action taken by the Vatican the supreme authority in the Catholic Church. Priest is supposed to guide the faithful to follow Jesus. But these kannada priests of Bangalore diocese are only worried about the language. They do not allow the people to pray in their mother tongues. These priests are not the followers of Christ but follow devil and as a result there is no peace in the Archdiocese of Bangalore. The Archbishop cannot take any action because he is afraid of these people.
    Well done to all those people who worked heard to produce necessary documents to the Vatican and the truth has prevailed and justice is shown. Those who are scandalous should be suspended from the church and this will be an eye opener to other priests who are involved in different types of scandals.

    May Jesus help the priests to be just and faithful to their vocation. May Jesus bless us all.

    Sad to hear such things in our community .sometimes the flesh is weak although Soul is against.There are many such cases Happening all over the world.Good that Pope has decided to be fair and set a end to this.Itwas very malicious that as priest decided to terminate pregnency if at all true (as per News)It was mord.I feel so sorry.It seems to involved in may cases.such People bring whole priesthood in bad light.Then when he feels he is not for priesthood meant ,please comeout and do marry and work elsewhere .Now it stinks up to heaven.Hope our other priests will remain to their priesthood intact and cause no Problems.when they feel it doesnt work,please come out.It is not at all a shame.but let us all pray in future such incidents will not happen,and may they remain steady to their Profession.It is hard but not impossible.If the church makes a new rule that priests can marry,would this Problem may be a big Revolution and help them.

Also, he is very modern in thoughts.. meeting with islamic heads, his views on LGBT community calling them children of god too, or his views that "it need not be necessary condition to go to church to be a good catholic"! ...I hope he is succesful in ventures.. this decision is path breaking!     I believe our present Pope Francis is determined to clean the clergy of such priests worldwide who indulge in sexual acts as catholic priests are prohibited from indulging in sex having taken the vow of celibacy.

    Also it is really a sorry state of affairs to see two groups of priests squabbling over language. What message are they sending to the faithful and non Christians about Christian conduct ? Is this what Christianity teaches us ? Pray this matter is resolved asap in a peaceful manner.
