Temporary reprieve for Daya Nayak
Mumbai, Feb 2 [07.30pm, IST]: Mumbai Police's encounter specialist Daya Nayak, his wife Komal and business associate Rajendra Phadte got a temporary reprieve after the Mumbai High Court barred their arrest until its order on their bail plea.
The three were facing arrest after a court in Mumbai rejected their plea for anticipatory bail. The bail was rejected by Judge S P Mahajan, who observed that there was a prima facie case against them. The Anti-Corruption Bureau opposed the bail plea, saying custodial interrogation of the accused was necessary.
Nayak, his wife and Phadte stayed inside the session’s court refusing to move out as their lawyer approached the High Court for bail.
But the High Court ruled that he cannot be arrested as the court has been working on his bail plea. The hearing in the case is scheduled for tomorrow, but it may also go up to four-five days.
Daya Nayak's properties were raided by the Anti-Corruption Bureau a few weeks back. He is charged with having wealth more than his known sources of income.
Nayak was earlier suspended as a sub-inspector with the Mumbai police. He is famous for his high-profile encounters against the Mumbai underworld. He claims to have shot dead more than 83 gangsters in shootouts.
On January 31, the court had reserved order on the anticipatory bail petitions of the three, till February 2.
The interim protection granted to Nayak, Komal and Padte continued till today as ACB was restrained from arresting them.
ACB has booked Nayak for possessing wealth allegedly disproportionate to his known sources of income. His wife Komal has been charged with helping him laundering his ill-gotten wealth
