Kerala 'rape' victim moves SC seeking permission to marry accused priest


Thiruvananthapuram, Jul 31 (IANS): A victim of rape has approached the Supreme Court (SC) seeking permission to marry her 'tormentor', a 53-year-old Kerala Catholic priest Robin Vadakkumchery who has been sentenced to 20 years in jail and was dismissed from priesthood by the Vatican.

The petition filed by the victim will now come up before the apex court on Monday and the victim has also sought bail for Vadakkumchery so that their marriage can take place.

The petitioner says this has been filed according to her wish.

Earlier, Vadakkumchery had approached the Kerala High Court with a petition seeking to marry the victim, but it was turned down.

Vadakkumchery was serving as a parish vicar near Kannur and was the manager of the Church-backed-school, where the victim, a Class 11 student was studying.

It was a Child line agency that works among school children that had registered the complaint against the priest.

The priest came under pressure after the girl gave birth to a child on February 7, 2017 at a hospital run by the management.

The priest was arrested on February 27, 2017 from near Kochi International airport while he was preparing to slip out of the country.

The priest was sentenced to 20 years imprisonment on February 17, 2019 by a court in Thalassery after he was tried under the Protection of Children from Sexual Offences (POCSO) Act.

During the trial, the victim and her mother turned hostile. Despite that, the court proceeded on the basis of evidences collected already and handed out the verdict.

Four nuns, another priest and one more woman attached to the convent, who were co-accused in the police charge sheet were let off due to lack of adequate evidences.

Incidentally in March last year, the Manthavady (in Wayanad district) dioceses officials informed the media that the Vatican after going through all the process decided to dismiss Vadakkumchery from priesthood.

    Agreed Mr. Hegde. Our society is yet to become entirely free from intolerance and religious fanaticism. I too have observed readers who had vehemently condemned the activities of Asaram Bapu and Swami Nithyananda have come to the defence of bishop Franco and this priest Robin when offences committed by all of them are almost the same.

    Cynthia DK,my suggestion is not important here .but their decision .When they want to marry without any outsider pressure can marry .I find it better becaause the child has a legal father ,not land in home.Mother too has a partner so long they lease him out ,so that other people may not hate her telling she mislead a priest.Their age difference is enorm.whether she can live with it I cant say.he is almost going to be sixty.she is almost 30 years old?or less ?Him will not be a problem but girl has to see if she gets more children how she will manage with finance when he dies?Their intim life too may not be happy.Atlast they both must decide of their own without pressure from outside.To Roshan Braganza Mumbai,age do matter .One has to experience it .Her intim needs are different than a man in younger age which a elder man cant fulfil .for example.

    @galdys UK , There is a reason i said so , for women menopause starts at 40 but for men they can procreate upto 90 years , so reverse cases r not possible , i feel 20 years age difference is fine , here its 37 , but looking at the severity of scenario , this is also fine.

    This is a stupid argument, Roshan. You cannot discriminate against anyone on the basis of their Gender. Menopause is a normal life event for both men & a woman and so it is not an illness. That’s totally wrong to treat a woman differently than a man. You know, this is called “Sex Discrimination” & "Age Discrimination”. Just to educate you, I have researched a bit on this topic. @Roshan when free go through this below link. You might get a bit of understanding of Menopause between both genders.     @gladys, UK , its pure biology and there is no cherry talking , show me the women who had healthy pregnancy after 45 , its very rare, but men fathering the child even at 60 s 70 s is very commons , its simple eggs stop at 45 for women ( general cut off age ) and men have procreation left till their ripe age , lets accept nature gave some privileges to men , there is discrimination but diversity here , further condemning age gap relationship is actuall age bias which has to be done away with....

    Roshan Braganza Mumbai,you cant fix the manopause in women at 40.It can also beginn earlier.Depends on their harmons.Some women have at 50 .It can also happen men have problems earlier than one thinks.

    Yes....Beautifully explained in short. Mr. Roshan understands this. Still his views on gender discrimination and age discrimination will not be changed......i have seen in the past too. He just compares the age of marriage for girls in different countries and tries to defend the acts of rape, molestation etc. He doesn't know every country differs from each other.....so as the people. Puberty, maturity differs in every country...

POCSO is highly illogical now a days even European develooed countries have age of consent at 16 , even 14 ( germany ) , canonical vatican age of marriage for girl is 14 . So its peculiar legal fiasco , looks like consensual intimacy but as she is minor its STATUTORY , hence priest has no other option to marry her once she turns 18 , if fornications laws were there ( as in Islamic court ) then girl will also get punished., i feel priest has to marry her and lead a laity life ( absolved of priesthood )

    Roshan Braganza ,Mumbai,I feel this girl the victim ,also really wants to get married with the priest,because in the past too she might have willingly gone to him ,as a teenager fallen in love with him.we cant proof and dont want now too.Otherwise priest couldnt bring her to him and lock .Otherwise when you think ,both have no good future .Let God decide what the future for them has.He should of course must as I feel undergo his imprisonment.Because he as a Priest had committed sin to rape a underage girl.When it came out he wanted to escape .Why?Now he wants to marry?I dont understand the mystery.

    Victim seeks permission from SC to marry the rapists who is more than 30 years Senior!!! It seems that she has been pressurised to get his release with marriage offer. Victim may be showing sympathy as she is unaware of the future consequences??? Ex priests supporters definitely offered her family financial benefits.

    Some authorities must have threatened and frightened this poor girl....so that this man can be relieved from jails imprisonment. So sad...how this girl can spend her life with him who is almost 37 yeats years older to her.......I remember our madam Rita from Germany, suggested the same advice of getting married to this man since he is the father of her child.     A class 11 girl would have been 17 years age. Just a 100 years ago, the average age of marriage for girls was 13-15 years. So, going forward, India may have to relook at some of the laws. Regardless, the SC cannot legally stop this couple from marrying. They have fundamental rights like everyone else.
