Centre moves SC challenging Karnataka HC order to enhance O2 supply


New Delhi, May 6 (IANS): The Centre on Thursday moved the Supreme Court against the Karnataka High Court order to enhance daily liquid medical oxygen (LMO) allocation for the state for treatment of Covid-19 patients from the existing 965 MT to 1,200 MT.

Solicitor General Tushar Mehta, representing the Centre, mentioned the matter before a bench comprising Justices D.Y. Chandrachud and M.R. Shah and sought an urgent stay on the order passed on Wednesday.

He submitted that the Centre would resolve the matter with the state.

However, the bench said it did not have papers in connection with the matter and it is not possible for it to pass any orders without going through the petition. The bench said it would go through the case files and order the registry to list the matter thereafter. The matter should be mentioned before the Chief Justice, the bench also added.

The Centre submitted that the High Court did not consider the rationale behind the allocation of oxygen to each state government.

In its order, the High Court said: "As an interim measure, we direct the Government of India to increase the cap on supply of oxygen to the State of Karnataka with immediate effect up to 1,200 MT per day. Depending upon the decision taken by the Government of India on the representation dated 30th April 2021 and further representation which may be made by the State of Karnataka, the Court will consider passing further orders in the next week as far as the quota of oxygen is considered."

The High Court had noted that the reason is that there is a number of reported incidents in Karnataka of death of Covid-19 patients due to non-availability of oxygen. "For upholding the rights of citizens under Article 21 of the Constitution of India, this is the minimum requirement of the State which the Government of India will have to comply with," it added.

    Center against state with their iwn govt. flighting in court.. what an example by central Govt to lead India. All states except UP (they are busy with gai) aa ll other centers are crying wolf for oxygen. Ehy center is controllong oxygen..let individual states handle it easily. Looks like this is a turning point for bhakts to learn their mistakes. Everything is no atock...covexin, covishield, Remdesivir, beds, oxygen, place to dispose bodies surrounded with lockdown, curfew, fear and orders and notices issued by every tom dick and harry. Pls dont treat people as criminals. Animals are better off than us today. They roam freely without fear.. take examples from other states and follow how they do to control the pandemic. Pls ban

    Such a heartless cheap politics by Modi and company. Even when India is becoming a graveyard he wants to hold control of life giving oxygen so that non BJP and BJP states have to come to him begging for oxygen. He will try to hold his seat in any way possible but this virus is sent by God to bring him to his knees. People now know that he is just a teaboy with a big mouth.

    It is interesting to see what supreme court has to say. It is Karnataka Highcourt Vs Supreme court + Central BJP government. The Karnataka BJP government has no say at all because Yeddyurappa's voice will be stiffled by Centre and Modiji. Yeh Dangal hai.

    To provide oxygen center doesn't want to guarantee the required quantity & rather doesn't care if people die in any state without availability or its inability to provide the same. Disgusting thing is the center wants to stay a humanitarian order of High Court through Supreme Court, might be missing past CJI s who had complied immediately every time center had approached it.
