Rape convict Catholic priest seeks bail to marry survivor, Kerala HC dismisses plea

Thiruvanthapuram (Kerala), Feb 18: The Kerala high court dismissed rape convict Catholic priest Robin Vadakkumchery's request for bail. The Catholic priest had made an outrageous plea to be let out on bail so that he could marry the survivor. However, the court dismissed the plea stating that there is no merit in the plea.

Justice Sunil Thomas, who dismissed the plea stated that granting the plea would be like giving judicial approval for marriage.

In July 2020, a POCSO court convicted Robin and granted him 20 years of imprisonment for raping and impregnating a minor girl. The convict had then moved to the Kerala high court seeking bail so that he could marry the survivor and take care of the baby.

But the high court dismissed the plea and said that cases relating to sexual offences would be dealt strongly and no compromises will be made or lenient view be accepted. It further said that the child being a minor during the offence still stands and granting bail would otherwise mean the court granting the nuptial.

In 2016, the survivor, a student of class XI was sexually assaulted by Robin who was the manager of the school. She gave birth in February the following year. Initially, under pressure from the church, the family of the survivor was forced to confess that her father had raped and impregnated her. But the family later revealed that the confession was made under immense pressure and threatens from the church. Later, DNA test conducted also confirmed that Robin was the father of the child. In 2018, after the survivor attained the age of consent, turned hostile and was ready to marry Robin. However, the court convicted the Catholic priest after observing that the survivor was a minor at the time of the crime.

In March 2019, after Robin was convicted by the court, the Vatican dismissed his priesthood.

The year after the verdict, Robin moved to the high court seeking for a bail plea. But the high court strongly opposed the plea. "We cannot encourage such suggestions because every rape convict will tell they want to marry the survivor,” public prosecutor Suman Chakravarti said.

    Generally speaking, men speak to gods and women speak to priests. Why exactly women get super-impressed by priests is beyond me. May be it is the leadership factor, or the mini-celebrity status. Can't entirely blame the man here. He did what an average man would do when a woman happily occupies his place/space. The Indian system, especially the Kerala system, is about punishing men. 150 years ago, most women married when they were 13 or 14 years of age. They were not legally minor then. A 17 year old person (like the "victim" here) would not have escaped some blame in a developed country.

    All have rightly posted strongly nothing to add.. Except Does the girl want to marry this offender and spend rest of her life with this monster .. this is the outrageous assumption/ favour shown of this so called priest !...to be stripped of priesthood .. not to suggest these atrocities don’t happen in all faiths .. etc etc .. list is long ... the victim can definitely find a better partner ...

    Look at his smiling face, as if he has achieved something great or going to receive an award! Should have taken photo with handcuffs or covering his head as he is unfit to show to show his face to public (for smiling), shameless guy. Unfit to be called Christian! forget a Priest!

    What an atrocious request, to marry the victim of rape while still in jail! No court on earth - or LAW - can countenance that. There are criminals like this priest in manay congregations. Sooner they are weeded out, the safer it is for society.

    Daniel mangalore we are not in stone age Court has given the verdict.He should undergo his punishment as its order.He has brought bad name to the religion ,priesthood and himself ,family.and to this girl.As court says everyone may seek bail ,want to marry ,just to escape punishment.No ,he should think over his deeds and moral of the story,dont do such criminal acts .Do what you preach .Why did he first denied his act,?He should have accepted it ,and comeout of Priesthood,care for the child,and marry the girl once she turnedout 18years.Now too late.Poor child will not be having the chance of see his father ,spend time as a child with father.and the girl?Is another matter.
