Bangalore, Jun 23: A copy of the Supreme Court judgment relating to the cold war between the Chief Justice of the state High Court, P D Dinakaran,and Justice D V Shylendra Kumar, was submitted to the bench of Justice Shylendra Kumar on Tuesday June 22.
It may be recalled that a division bench comprising Justice D V Shylendra Kumar and Justice N Anand Bhyrareddy had asked the two registrars as well as the registrar general of the High Court on June 11 this year to place before it a copy of the order passed by Justice P D Dinakaran relating to a tax case before it. Against this order, the registrars had moved the Supreme Court as per the CJ’s directions. The Supreme Court has stayed the operation of the said order passed by the division bench.
Commenting on the fact that the High Court had appealed to the Supreme Court against its own order, Justice D V Shylendra Kumar observed that this was like scoring a self-goal. He also observed that the respondent shown in its petition by the High Court registry, i.e., the insurance company named in the tax case, had no stake in the proceedings. At the same time, he concurred with the view that the Supreme Court being the highest court of the country with appellate jurisdiction has every right to stay the order of a lower court.
