Bengaluru, Feb 4: A female disciple of Swami Nithyananda has told the high court that the popularity-savvy Guru, who is facing rape charge, is on spiritual tour. But she did not mention where he is now.
Complainat Lenin has filed an application seeking cancellation of bail granted to Swami Nithyananda in 2010. The single judge bench of the high court chaired by Justice Michael D'Cunha, conducted hearing on Monday, February 3. After listening to both the sides, the court reserved its orders.
Advocate appearing for Lenin told the court that Nithyananda had left after obtaining visa of Belize country and that he has never appeared for hearing after June 5. 2018. As the second accused in the case also is absenting from successive hearings, he sought cancellation of Nithyananda's bail.
The judge expressed ire against the police and wanted to know whether this is the first time they are delivering court notices. He also asked them whether they are not ashamed to give silly reasons for non-delivery of summons and questioned them whether they are playing games.
The police in their affidavit said that they were unable to deliver the notice to Nithyananda Swamiji and that it was therefore delivered to his disciple Archanananda. This affidavit was provided by deputy superintendent of police Balaraj.
The summons served to Nithyananda was not delivered. It was received by his disciple, Archanananda, who has responded by saying that Nithyananda Swamiji is not in Bidadi but on spiritual tour. Therefore public the prosecutor opined that it would be proper to conduct hearing after summon is delivered. They said that Nithyananda's presence is not needed now, and bail conditions have not been violated.
Justice D'Cunha opined that the hearing cannot be indefinitely put off waiting for delivery of summons. He adjourned the hearing to February 5 to pass orders in the case.
