Bengaluru: 14 MLAs to challenge their disqualification in Supreme Court


Bengaluru, Jul 28 (IANS): All the 14 Karnataka rebel legislators, who were disqualified by Speaker K R Ramesh Kumar on Sunday for defying their party whips to attend the House on July 23, said they would challenge the Speaker's decision in the Supreme Court on Monday.

A day before the trust vote on the B.S. Yediyurappa government in the Karnataka Assembly, the Speaker disqualified 14 rebel MLAs of the Congress and Janata Dal-Secular (JD-S) for defying their party whips to attend the House on July 23, when former chief minister H.D. Kumaraswamy put the confidence motion to vote for proving majority, but failed to do.

The rebel MLAs said they would challenge their disqualification in the Supreme Court as their joint petitions had sought its directive for accepting forthwith their resignations re-submitted on July 11 before the Congress and the JD-S issued a whip to them to attend the session on July 23 and long before former chief minister H D Kumaraswamy moved the confidence motion on July 18.

    My humble request to the Supreme Court justice to kindly upheld the Karnataka Speakers the decision disqualifying 14 MLAs and refraining from defecting to any other party.

    The voter voted according to their conscience and belief by reviewing party’s manifesto and elected their representatives anticipating to fulfill whatever is promised. If I have voted against changing the constitution and the candidate wins, he/she should not defect to any party that support the abolition of reservations. This is violation of voters right, breach of trust, betrayal, unethical, immoral and against natural justice, if not illegal.

    We also hear about “Horse trading” which is detrimental to democracy. A rich person or a country, Per Se, pump in billions of dollars, invest in horse trading and buy enough legislators to change the constitution to their favor. If a single party has 2/3 majority in every States, it is possible that they can abolish not only reservations, but also Supreme Court, Reserve Bank, Election Commission, Lok Pal and other statutory body leading the nation to dictatorship. The essence of democracy is to have checks and balances in governance. We do not want India to be another Venezuela.

    Further, the disqualified legislators should be barred from contesting the election for at least 6 years. They should also be held liable for reimbursing the cost of re-election in their constituency, so that the tax payors will not be burdened for their selfish motto. The SC should also consider the inconvenience caused to the voters to go to the polling booth again for re-election sacrificing their daily bread. Therefore, the SC can allow the party to nominate 14 new legislators without any election for the remainder of the term. This system has been followed by the other democratic countries.

    Suprime court ಗೆ ಹೋಗುವೂದು ಯಾಕೆ? Reserve Bank ಲೂಟಿ ಮಾಡಿದರೂ ಸಿಗದಷ್ಟು ದುಡ್ಡು ಈ 14 ಕತ್ತೆ ಗಳಿಗೆ ಸಿಕ್ಕಿರುತ್ತದೆ.

    This defected MLA's have no ethics. Ethics were not a consideration for the BJP either.
    In our democratic system deflections are 'Contagious disease'. These defections are against the voter's mandate.
    The elections in India are not paid by the MLA'S. It is from taxpayers own money. For 2019 alone more than Rs60,000 crores have been spent officially. The BJP alone spent Rs28000 crores in the just-concluded Lok Sabha elections. Each voter cost India Rs700.
    These elected MLA's resigned before the completion of five-year tenure of the government. Each assembly constituency cost India Rs10 crores to the held election.
    1. Now 20 of them being resigned who will accountable for re-election cost?
    2. Why did the government need to spend for reelection from taxpayers money again?
    3. Why the party should give them tickets who can't keep the promise to the voters under the symbol they contested?
    4. Why the RBI, Life insurance should shoulder the burden of government debt. due to these elections?

    I think the BJP camp will be very happy with their disqualifications. Now in the ruling seat, they don't have to deliver the promises they made to woo these MLA's who resigned from the elected party.

    I humbly appeal to Supreme Court of India to respect the voter's mandate. We the citizens of this nation want the end to this 'horse-trading' regardless of parties.

    Save our democracy. Keep the honor of the blindfolded 'Lady of Justice'.

    You woke up now in 2019? Ayaram gayaram was started by ur emergency rani Indira right from 1969 when she divided the Co gress and started khangress.
    So now what you claim as grand old party it is just 50 years old.
    The changes /conditions you mention requires a complete change of Constitution as the original writers did not expect this mean behaviour from elected ppl.
    Now you feel the heat and say changes r needed but when AKH said there is a need of change of Constitution you chaddiless blamed him.
    When there can be more than 100 amendments why not rewrite new one?
