Bengaluru: Speaker disqualifies 14 rebel Congress, JD(S) MLAs

Bengaluru, Jul 28: Assembly Speaker Ramesh Kumar has disqualified  14 Congress and JD(S) MLAs. most of whom had resigned three weeks back. 

Speaker was addressing a press meet here on , on Sunday, July 28.

The disqualifications were based on the petitions filed by Congress and JD(S) Legislature Party leaders.

The 14 MLAs had failed to attend the House on July 23, when former chief minister H.D. Kumaraswamy moved the confidence motion and lost by 6 votes.

"As the remaining 11 Congress and 3 JD-S rebel legislators defied their respective party whip by absenting from the Assembly on July 23 when the motion was to put vote, they have violated the anti-defection law," the Speaker told reporters as one of the reasons for disqualifying them under the 10th Schedule of the Constitution.

Three rebel Congress legislators, Ramesh Jarkiholi, Mahesh Kumthalli and R Shankar, were disqualified on July 25 for defying their party whip issued to attend the Assembly and vote in favour of the motion former chief minister H.D. Kumaraswamy moved on July 18 but lost on July 23 by 6 votes. 

The MLAs are Pratap Gouda Patil (Maski), B C Patil (Hirekerur), Shivaram Hebbar (Yellapur), S T Someshekhar (Yeshwantpur), Byrati Basavraj (K R Puram) Anand Singh (Vijayanagar - Bellary), R Roshan Baig (Shivajinagar), Muniratna (R R Nagar), Sudhakar (Chikkaballapur), MTB Nagraj (Hoskote) and Shrimant Patil (Kagawad) from the Congress, and A H Vishwanath (Hunsur), Narayan Gowda (K R Pete) and K Gopalaiah (Mahalakshmi Layout). 

New chief minister B S Yediyurappa has to prove his majority in the state Assembly on Monday.

    In my opinion, keeping the party politics aside, the Supreme Court of India will approve Speaker's decision. It has been a copy of Tamil Nadu state model.

    As the elected MLA's failed to observe their party whip, the closely lost candidates in each of these constituencies should have (still could) file an affidavit with the Indian Election Commission and the Speaker of the House to declare them as winners. EC and the Speaker of the House would have granted their plea, Supreme Court would have upheld EC decision. BJP would have obtained absolute majority in the house.

    Disqualification is not enough. These legislators should go to jail for betraying the voters and the party that gave them the ticket to run. Voters took off from work, waited in line for hours to cast their votes. If we knew that they were defecting to another party, many voters would not have elected them at all.

    MLAs resigned on July 6th.

    When SC told them to meet Speaker personally and resign, they did so again on July 11th.

    SC told them they need not attend Trust vote as they have resigned.

    SC said Speaker just had to accept the resignations within a reasonable time.

    Now the Speaker who said he doesn't work on holidays has disqualified them on a Sunday.

    22 days after they resigned. No mention of their resignation.

    SC will declare Speaker verdict as arbitrary and illegal.

    Once disqualified neither BJP can have them and the same decision will be upheld by SC which again upholds speaker's ruling. Disqualification is with regard to violation of rules unlike resigning which SC can not set aside as per the constitution.

    Apex court can over rule the speaker and grant chance for then to contest in by election. Here Apex court is supreme and not the Speaker. Speakers judgement can e questioned in Apex court. So these rebels will loose if they don't appeal against the Speakers order.

    I am saddened and ashamed the way our politicians in Karnataka have turned out to be. They all have stooped to levels that is worse than a drainage pit. They have no right to hold the public to ransom. They are public servants and we have sent them to represent us and get the job done. Irrespective of any party, these guys should be thrown out of politics forever, if they indulge in such cheap acts. Noone should be allowed to resign or change parties until they have finished their terms. Instead they should seek people's permission to decide on such matters.

    Under the 10th Schedule of the Constitution, a legislator is considered a defector if he/she gives up the membership of the party on whose election symbol he/she has been elected to the House or disregards the whip issued by the legislature party. In such a case, he/she can stand to be disqualified from the membership of the assembly or Parliament.
    The rebel Congress and JD(S) MLAs were innovative. They did not resign from their respective legislature parties but chose to give up membership of the assembly in a bid to escape disqualification. They now have the option of contesting the by-election, which will have to be held within six months on the symbol of a different political party from the same constituency, and return to the House if they win.
    SC Order In Karnataka MLAs Case Goes Against The Spirit Of Anti-Defection Laws.

    As per clause 2(b) of schedule 10 of the constitution, abstaining from voting in House contrary to any direction issued by the political party to which the legislator belongs to will cause disqualification on the ground of defection.

    Acceptance of resignation a matter of speakers discretion.

    This is clear from the proviso to Article 190 3(b) of the constitution, which says that the Speaker shall not accept resignation if he is satisfied that it was not voluntary or genuine.
    Karnataka BJP wanted to follow the 'Manipur Model' of defection. In Manipur, HC has come down heavily on the assembly speaker of the north-eastern state, under the BJP’s rule, for not disqualifying a Congress MLA for the last two-and-a-half years.
    In the 60-member assembly the BJP, with 21 seats, stitched up an alliance three regional parties thus taking its tally to 30 seats. This was still one short of the majority mark. So lone Congres member for the Ministry defected to the BJP thus helped the party form a coalition government. Later another 6 joined & sat with the opposition just to avoid the anti-defection law.

    The legislature are required to be in assembly when session is going to represent the problem of constituency.     This is what these so called elected leaders deserve. During elections tehy go home to home begging for votes and also promising voters to work for theme. Then once elected , you take your own decisions to resign or run to Mumbai and stay in resort while leaving ur people in misery ??
    where the voters will go ?? for them their trusted party and elected leaders are the voice at the assembly.
    1, 2.......Total 16 ????? For whatever the reason they did it dont know but they need to answer their inner consciousness ....
    All voters who voted for them , need to go to these leaders home and ask questions on their this act.
    many leaders are taking Demorcracy for granted .
