Bengaluru, Jun 27: "The law and order situation is completely gone for a toss. Has this become a Police Raj? If this state becomes Police Raj, then it will not be possible for people to roam freely on streets," said High Court in a statement expressing rage against the police atrocity on Jaikanth, admin of 'Troll Maga' for posting derogatory posts against former PM H D Devegowda, chief minister H D Kumaraswamy and Nikhil Kumaraswamy on various social media sites including Facebook and Instagram.
The high court condemned the action of Sriram police of the city of keeping Jaikanth in their custody for five days and registering a second FIR against him. The court ordered the police to release Jaikanth from police custody immediately.
"Though the sessions court had given anticipatory bail to Jaikanth against the first FIR registered by the applicant, the police arrested him after registering a second FIR in the same case. The complaint was first given in the letterhead of JD (S) chief secretary and then for the second time on the letterhead of IT unit of JD (S). Is there no value for the order of the court? Why the anticipatory bail applicant was taken into custody, filing a second FIR, though the sessions court had granted him bail? What was such a necessity and emergency?" questioned the justice, who was furious.
The civil judge further said, "Moreover, when we see this incident it seems that the law and order is completely taken for a ride in the state. There is a feeling that there is no administration of law in the state. In a democratic state such an incident is condemnable. The interference of police in Civil cases is increasing day by day. Police poke their nose in commercial as well property issues also. The court has already ordered the police to change their behaviour. Last week itself the DCP was called and instructions were given. But the behaviour of police is continuing as usual. Incidents of this nature should not occur at all and the situation needs to be improved at any cost."
Justice Dinesh Kumar further said to the advocate general, "I had participated in the programme about police that was held in the office of the DGP recently. I spoke with the DGP casually and said that programmes of this kind are a waste. Let I and you select 12 police stations randomly in the city and go in civil dress to file complaint. The stations will not register the complaint. The situation is turned worse to that extent."
