Mother fighting for justice after husband abducts kids, takes them to Abu Dhabi

Mangaluru, Nov 17: The Human Rights Protection Foundation (HRPF) is fighting to give justice to a mother, who is having sleepless nights after her husband abducted their two children.

Rishana Nilofer of Ullal, who has delivered her third child on September 10, is having sleepless nights after her husband took their first two children to gulf, without informing her.

Rishana daughter of renowned businessman Siddhiabba was married to Shanib employed in Abu Dhabi, eight years ago. On September 8, he arrived Mangaluru as Rishana was about to deliver their third child. On September 10, a girl was born to the couple, whom they named Nuha Mariam.



On September 18, Shanib took their first two children Sheraz (6) and Zuha (1.5) out on the pretext of buying them ice-cream. However, he took them to Abu Dhabi and informed Rishana at around 10 pm. For the next two days, he kept his wife updated about the children through whatsapp images. After that he cut communication with her.

On October 1, a helpless Rishana approached the HRPF with her 20 day old baby. She was panic stricken and on the verge of depression and HRPF members counselled her and advised her to file a police complaint as well as approach Jamaat to resolve the dispute peacefully. However, even after two months of abduction, the elders of the community couldn’t succeed in resolving the dispute.

Abusive marriage

Rishana’s marriage to Shanib was an arranged one. Her parents gifted 130 pawans of gold and a flat in Mangaluru to Shanib’s family as per their demand. The marriage was solemnized with the consent of both families in the presence of the seniors of the Jamaath.

Ever since Rishana got married, she was ill treated by her husband and mother-in-law. She was always taunted and degraded on the ground that she was not well qualified. She often had to face physical and emotional abuse that led to mental agony. All the basic needs including clothing were provided by her own parents, even after marriage. She was always treated like a slave by her husband and mother-in-law. Rishana told HRPF that she was allowed to have her dinner only after her mother-in-law returned home at midnight.

Support from the Muslim social organisations

Many Muslim social organisations extended their moral support towards Rishana. Samman Counselling Centre have contacted Kannadiga friends in Abu Dhabi who have promised to resolve this dispute amicably.

Legislation in this regard

A committee of advocates from HRPF has submitted a detailed report after analysing the entire case law. As per the Muslim Sunni sect, a girl child shall be in the custody of the mother till she attains puberty and a boy child till he attains the age of 7.

Complaint to the External Affairs Ministry

Since 2 months, no important member of the community or social organisations succeeded in resolving this problem. Though a complaint was filed at Ullal police station on October 11, they have not taken any action in this regard. Currently, there is no communication from Rishana’s husband and his family members. To proceed legally, HRPF has already contacted advocates.

HRPF has submitted a detailed report in this regard to Sushma Swaraj, External Affairs Minister.

HRPF president Ravindranath Shanbhag demands that the Indian Embassy has to take immediate action to bring the children back to their mother, otherwise there is a possibility of the mother’s life being endangered.

    This issue can be solved through counselling of both. After all, every family will be having problems one or others.

    Need to solve through counselling & we should pray for them to lead happy life . We public knows only few things about their family matters. Already they have 3 children . These 3 children should not loose their parents.

    As per Islamic tenets also its a crime on the part of the man who abducted the innocent children.
    The concerned person should be dealt with legal action for this criminal offense.
    The poor lady Rishana would have taken legal steps for the harassment against the intolerable husband and in laws earlier.
    Even the Islamic law gives her a right to get Khul'a (wife's demand for divorce) from such husband and she should have gone for it.
    Anyways the elders of the community in India and abroad shall come forward and cooperate the lady's family to get the justice.

    Very sad and painful to hear the mothers situation.I hope external affairs minister Sushma Swaraj should be contacted through Mangalore MP Nalinkumar ...Nalin should be asked to appraise the matter what other special interest with minister ....hope for till hear good everything.

    It is a serious matter. This man and family should be arrested soon in abuducting kids. Not sure how the airport authority allowed to board the flights without the consent of the mother. Both parent required consent to board the flights. It is sad that one parent took the children without the knowledge of other parent to a foreign land. It is serious legal matter. This man should be arrested without wasting a single minutes. Married people has issues and when option s to talaque and re marrie is another open doors such idiots to marry so many times and destroy the life of women and in this case little kids. It is common for these idiots and has to be dealt in a democratic world. We don't live in Saudi Arabia but we live in democratic india where men and women treated equally. Please respect

    Hard.specially these abducted children will be suffering missing mother and a complete unknown surroundings.second the newly delivered mother too suffers a lot with small child.what a situation !Such man like this shouldnt marry first,or when then have the decency to support a family by working self not beg from brides family for a flat and gold.He should shame for it.first of all brides family shouldnt give what he asks.when then make the flat in her name.so much gold ,he may now go elsewhere and marry another one without telling about first wife.children may land at inlaws.Big problem will be suppose this man takes the children to other muslim country like tunesien etc.it will be difficult for mother to bring back these children,because they dont allow children to takeout without fathers consent.Big problem.Hope it will be solved with very amiciable way.and may children join family and unite(which i doubt)Even when they get together life for her will be a big way of crucifix.may God help her.

    Here, the new mother cannot go to Abu Dhabi because the new child does not have a residence visa. Secondly, if she take legal action, the man can be arrested if he sets foot on any of the airports in India.

    Hope there is a amicable resolving to this matter so that the children will not suffer.

    Nevertheless, those of you who pestered Indian Govt for abolishing Tripple Talaq, will appreciate the move when case such as this takes place.

    It’s parents mistake to marry her for bhikaari. There are millions of shameless youngsters who invite lots of friends and family on marriage day . Daughter is asset , why again spend lot of wealth for tha marriage day. If groom is gentleman let him spend from his pocket. Until unless parents will not stop spending for daughters marriage there are millions of bhikaris ready to use the opportunity for their image.
