Kerala HC disqualifies Muslim League MLA KM Shaji for using religion to win polls


Kochi , Nov 9 (PTI): The Kerala High Court on Friday disqualified an Indian Union Muslim League (IUML) MLA on a plea claiming that he used religion to win the Assembly polls in 2016.

Disqualifying KM Shaji, who had won the elections from Azhikode Assembly constituency in 2016, for six years, Justice P D Rajan directed the Kerala Assembly Speaker and the Election Commission to take appropriate action.

The court gave the judgement on a plea filed by LDF candidate M V Nikesh Kumar, who contested the election against Shaji. IUML is a partner of the Congress-led opposition UDF in the state.

In his petition, Nikesh Kumar alleged that Shaji secured a win by a margin of 2,287 votes using corrupt practices. He accused Shaji of having violated norms prescribed under various sections of the Representation of the People Act to win the elections. Nikesh had alleged that an appeal was made to voters by Shaji, who belongs to the Muslim community, his agents and other persons to vote for the UDF candidate on grounds of his religion.

He had also charged that pamphlets were circulated in the constituency urging people not to vote for a candidate who is not a believer of the Islamic faith.

IUML said it will take a decision on filing an appeal after getting the judgement copy.

    I would say this is a good beginning to cleanse the 'Democracy' of India. If this judgment is taken literally, then pretty much every single party in India could be disqualified. Year after year, we have seen the misuse of religion, religious icons, caste, castiest symbols and appeals destroying the fabric of the Indian Republic's democracy and social harmony.


    In 2017 4-3 ruling, SC has baned seeking votes over religion, caste, language.The Supreme Court judgment barring politicians from using religion for electioneering must be welcomed by every citizen who loves this great nation.The court held that the provisions of the R P Act, which say that seeking vote by a candidate in the name of "his" religion, caste, race, religion and language in the election law, included candidates, his agents and voters also.

    "An appeal in the name of religion, race, caste, community or language is impermissible under the R P Act, 1951 and would constitute a corrupt practice sufficient to annul the election in which such an appeal was made regardless of whether the appeal was in the name of the candidate's religion or the religion of the election agent or that of the opponent or that of the voter's.

    Let India rise on the prowess of development, honest money, and a non-religionist political discourse.'
    'That will secure our future and also make an impact on the theologically run sham democracies in our neighborhood.
    Now Kerala High Court should also consider the statement of state BJP President in Sabarimala controversy and ban the 'Rath Yatra' polarising the vote bank.

    Why other HC are not disqualifying the MP/MLA talks about religion. Politics is different and religion is different...... If anyone uses Politics in religion or religion in politics must be condemned and courts has to disqualify them.

    Using religion to get votes should be banned. let an ordinance come from the apex court banning candidates if they use religion and religion related issues for vote and play with the emotions of people and create communal tensions. What actions would be taken for some politicians as they publicly want votes of majority religion people only and do not want minority votes
