First in India: President assents Karnataka’s Good Samaritan bill

New Delhi, Oct 1 : President Ram Nath Kovind has given assent to a bill, India’s first, which will give legal protection to the good samaritans in Karnataka who help accidents victims with emergency medical care within the ‘golden hour’, officials said Sunday.

With this, Karnataka has become the first state to give legal protection to good samaritans through a legislation amidst the rising incidents of accidental deaths in India, which saw 1,50,785 people getting killed in road accidents in 2016.

The president has given his assent to the Karnataka Good Samaritan and Medical Professional (Protection and Regulation during Emergency Situations) Bill, 2016, a home ministry official said.

The legislation aims to give protection to good samaritans and ensure immediate medical assistance for road accident victims within the ‘golden hour’ and encourage people to offer first aid to victims without fear of harassment in the hands of police and investigations.

In medical term the ‘golden hour’ is the first hour after a traumatic injury when emergency treatment is very crucial.

Under the new law, the Karnataka government will provide financial help to good samaritans who help victims in a timely manner, they will be exempted from repeated attendance in courts and police stations, in case attendance is mandatory, expenses of such “running around to courts and police stations” will be taken care through the proposed ‘Good Samaritan Fund’.

After admitting the accident victim to the hospital, the good samaritan can leave immediately, all government as well as private hospitals are bound to give first aid to the accident victims, according to the new legislation.

Another official said there have been many instances when people get busy in clicking photos or making videos of the victims, instead of providing the accident victims medical help.

“With the new law, there will be clear message that good samaritans will not be harassed in any manner,” the official said.

There were 4,80,652 road accidents in the country in 2016 in which 1,50,785 people were killed. In 2015, there were 5,01,423 road accidents in the country in which 1,46,133 people were killed.

Karnataka is one of the top five states which saw a large number of people getting killed in road accidents in 2016 and 2015.

There is no central law to protect the good samaritans. However, the Union Surface Transport Ministry had issued a set of guidelines in 2015 following a Supreme Court order to protect the good samaritans.

    Good Samaritan bill should not exist if our govt was competent enough.

    It is the govt`s duty to provide emergency services within 10 minutes distance from any spot. Govt should provide emergency lanes for the Ambulance/fire engines to move as quickly as possible. When there is an accident its important that the injured person is not moved. This is because in case of spinal injury moving or lifting without proper support could potentially be fatal.

    Those who stay in UAE would know what I am talking about. There the medical assistance is provided as soon as possible. they have emergency lanes. No one can be on the emergency lane obstructing emergency vehicles. If you see the accident, you are supposed to call the police and that's it. Nothing more. you cannot stop at the accident scene and take selfies/photos/video. Do that and you would end up in jail.

    you are right that's the way it should be, but look at our roads they are making the roads , not constructing them !, some roads are only two lanes and no sideways. look at Mangalore - BC road - NH46 , after 20 years also it is not complete !, Pump well circle ...long list. Safety is quite apparent word, where as corruption is stable and consistent in Peoples Mind . unless we the People stand against the corruption that will age along with us mature. need to be vigilante amongst ourselves in our neighborhood, in our society, then we can expect a better politician arising from here !!!

    as per bill, Govt will pay the Expenses for Running Court and Offices...


    my concern is again : to get reimburse the above expenses from Govt Fund...we need to daily run behind govt officials and Govt office and we need to pay them bribe....( again Govt will pay this expenses???? )

    Nothg can expect from Corrupt Govt Officials

    Excellent work and congrats to to all concerned. This is to help victims ..... However it would be a good idea if law is passed to make it mandatory for all erring drivers to attend classes to be conducted by The Police Department and suspend erring driving from driving until the training sessions are over. This is what is being done in America and other countries.

    Glad to read your comment, now being a seasoned traffic warden. Government of KT should be congratulated for this law which will encourage people on site to help as soon as they find distress due to a traffic accident. My only hope is that there will not be "ambulance chasers" to claim reward/compensation, which sometimes happens with towing firms, and a fracas to claim who is first on the scene!.

    You have RTO.. Summons all drivers to class room session... Make attendance compulsory... Otherwise cancel driving license... Regularly driving skills should be tested for validity
