Christian bodies express discontent on Madras HC observation over governing church properties


Chennai, Nov 19 (IANS): Several priests and members of the Christian community have expressed their discontent over an observation made by the Madurai Bench of the Madras High Court suggesting that church properties should be governed by a statutory body similar to the Waqf Board.

Father John Kurien, a retired priest based in Coimbatore, voiced his discontent regarding the court’s remarks.

“Church properties are all registered and have proper records. This includes not just churches but also educational institutions and hospitals managed by the Church. Such a proposal could infringe on the constitutional rights of minority communities. The Constitution of India allows minority communities to establish and govern their institutions,” Father Kurien told IANS.

The observation in question arose as Justice M. Sathish Kumar of the Madras High Court sought the views of the Union and Tamil Nadu governments on making Christian institutions more accountable by bringing their assets, funds, and entities like hospitals and educational institutions under a statutory board similar to the Waqf Board.

Justice Sathish Kumar remarked: “While the charitable endowments of Hindus and Muslims are subject to statutory regulation, no such comprehensive regulation exists for Christian endowments.”

He further noted that the current oversight of these institutions is limited to litigation under Section 92 of the Code of Civil Procedure.

The court has also impleaded the Union Home Ministry and the Tamil Nadu government in the case.

The observations were made while hearing a batch of petitions concerning the appointment of a correspondent to Scott Christian College in Nagercoil, Kanyakumari district, and issues related to salary payments for employees.

The court observed: “Churches not only hold vast properties but also manage educational institutions. Often, these institutions, which are meant to be protected and safeguarded, suffer administratively and financially as their funds are drained by internal power struggles.”

To address these issues, the court noted that it has routinely appointed administrators in litigation involving various dioceses as a temporary measure.

Justice Sathish Kumar also pointed out that trusts, trustees, charities, charitable institutions, religious endowments, and religious institutions fall under the Concurrent List (List III) in Schedule VII of the Indian Constitution.

He stated: “There is no central legislation in this area, and there is no restriction preventing the Union or state governments from introducing legislation given the prevailing circumstances.”

To enhance accountability, he suggested the need for a statutory board to regulate the administration of church properties and institutions.

This observation has been opposed by church bodies.

Two prominent organisations — the National Council of Churches in India (NCCI) and the Catholic Bishops’ Conference of India (CBCI) — which together govern about 90 per cent of the churches in India, have already expressed their concerns.

Father Robinson Rodrigues, spokesperson for the CBCI, told the media that the organisation’s legal department is conducting a study on the implications of the observation.

However, he declined to share further details, citing that the matter is sub judice.

Father Samuel George, speaking to IANS, emphasised that church properties were purchased, not acquired through donations.

Another priest, who preferred to remain anonymous, called the court’s observation “unfortunate,” adding, “We are awaiting the final judgment and will respond accordingly.”

    Well,one side I find its ok ,let govt,look out into all religious properties and consider the best.When all other religious institutes have to give up their income and outlet why not christians?But how far one can believe they do better?As all other govt.offices ,here too there is possibility to be misused? Even in cathoilc institutes there was some misunderstanding sometime back People were very unhappy.So in future let that not happen.Afterall all are humans .

    Very nice move, I appreciate with high court.. government should get all accounts details from private institutions. We all are Citizen of India . So all are equal. Mainly Our Church administration only bother about money, Looting in the name of religion . Our Priest are only want money for everything nothing in charity not bother about the poor and needy people . Our priest are available only in payment harassment to the people in the name of church rule and law.

    One must take note that., the Court's attention & intervention was drawn by the fighting groups within the Church Executive Committee ...., there is an iota of locus in Court's observation., The fighting factions must be educated with the Constitutional provisions & privileges., The object of the Constitution prevail over the provisions of the Constitutions., However, if Court chooses to uphold the need for a Governing body as an oversight authority (limited to review of administrative functionality... let it be) over the affairs of the Church & its institutions, to some extent it should be seen as a welcome approach.,

    When temples funds are managed by the government , then it is fine… when it comes to non-Hindus then there is a problem.. should it be not be applicable to all religions in the same fashion? Btw, this was established by HC of TN, where the government is that of DMK

    You dont even know what's Muzrai dept, in karnataka more than 35000 temples and in tamilnadu more than 47000 temples are under govt control thousands of crores received by devotees from these temples goes to the govt and they utilese as they seem appropriate, why should Hindu temples be under Govt control release them, thousands of crores can be utilized to build Scholls to improve temple etc, why not other communities religious places is under govt control, aren't we a secular country ?

    @ Nithina., your moot point is apt & has some rational and merit... its most welcome., meanwhile suggest the modus operandi .... out of say 40K or 50K or 500K temples/Gudi's/ Gurudwara's/ Mandira's., how many will go to Brahamana's, Konkana's, OBC's and other sub-casts., Marwadi's, Jain's, Bunta's, Padmashali's, Mogaveera's, Billava's etc., One more issue can Brahmana's takeover Bhootha Gudi's or can Billava or Bunta's take over Krishna Mutt's, Rama Mandi's or Kashi Sansthana's..., who will take Ayyappa Temple, Guruvayur temple, Anantha padmanabh temple of Trivendram., How can we address this without any conflict/challenges., Can a Purohit who support Dongi Congi political party allowed to serve & conduct rituals at Shri Ram Mandira.., can you spill some thoughts of your on these matters..,

    FYI, this is the observation made by Madras HC which is opposed by Christian bodies. There is no petition or response so far from TN govt. It would be interesting to know who is prompting HC to make such statements in order put such ideas on minds of fringe elements to start unrest. Don’t make your own fake pre assumptions. Open your eyes and read the news article.
