Mangalore: MSEZ Prays for Permanent Injunction against Villagers

Mangalore, Jul 4: Mangalore Special Economic Zone Ltd (MSEZ) had filed a petition in the court of the civil judge(junior division) here on Monday June 30, seeking permanent injunction against some villgers, restraining them from entering the land acquired by it at Permude village. The petition came up for hearing in the court on Thursday July 3.

MSEZ said that it was in possession of 15.34 acres of land in Kudubipadav in Permude villag which was acquired by Karnataka Industrial Area Development Board before handing it over to them. It explained, that Mallappa Gowda, Giriya Gowda, Deveppa Gowda, Honnayya Gowda, Lilli Misquith, Prashant Lawrence Misquith and Teresa Noronha, who no more enjoyed any rights over the land in question, were entering the land and undertaking agricultural activities there. It said that the defendants were only entitled for compensation for the land acquired from them, from the state government.

On Thursday July 3, only one of the defendants Mallappa Gowda could file objections in the court, as the others arrived late due to the Bharat Bundh. The case was posted for today to enable others to file objections if any. MSEZ wants to undertake construction work in the above land acquired by it, which is a part of about 1,800 acres of land acquired for the project.

    Dear Sirs at Daiji, The 15.34 Acres at Kudubi Padav is not a part of already acquired 1800 acres. It is part of the 2035 acres of land identified for the 2nd phase of MSEZ, acquisition of which was stalled last year due to protests of farmers.

    Malcolm, mangalore/gujarat, Dear Sr, Growing vegetable and rice for livelihood and to feed persons like me is not natak. How would you feel when one fine day you are thrown out of your house and told that your land is handed over to some XYZ and you have been paid for your house? (when you know that not even in your dream any transaction has taken place)

    scene -1 KIADB acquires 1800 acres for 1st phase of MSEZ.

    Scene - 2 A rich fellow who leads the group of farmers loosing land for the 1st phase of MSEZ facilitates land acquisition.

    Scene-3 He declares village temple and Bhoothasthana as his family property and demands alternative land and compensation.

    Scene-4 He buys land in non acquired part of Permude . His eyes fall on the fertile 15 acres of land of Kudubi padavu which is right next to his newly built house.

    Scene-5 Tells MSEZ that it is the right land for relocation of his temples. And MSEZ agrees, KIADB succumbs.

    Scene-6 KIADB hands over the land to MSEZ. Company claims 15 acres as land in it's possession. The agriculture dependent Gowda's and Misquiths are shocked. Because they had never intended to sell, and nobody had asked them for their land. They continued farming because they had not sold it anyone. They wonder, how on earth some can just enter their property, throw them out and start fencing their land that too for someones family temple?

    This seems to be Natak for others but not for Gowdas & Misquiths. MSEZ may claim they got the land from KIADB hence they are the absolute owners enjoying all rights over the land. Claim may not valid if the Gowdas & the Misquithas are not fully paid and/or if they were also not given alternative accommodation as greed against their sale. If no, they have the right over the land till it is done. They are right in entering over the land. MSEZ is wrong.

    MSEZ has insufficient title/right over the land. As per law the stolen property purcased by the buyer gives him no ownership for he has got only the possession but not the title. It applies to this unpaid land also where the title was not passed on to KIADB who in turn can not pass on to MSEZ what they do not possess. That is the case here. That gives the Gowdas & Misquithas right to enter into their land else why they should come back. It is sufference not "Natak".

    naatak phirse is liye chaalu huwa ke Misquith aur noronha ne KIADB acquire kiya huwa jameen par badane and basalhe lagane ki koshish kiya . ye to naatak hote hi rahega
