Bantwal, Jan 15: The bail granted to three accused persons relating to the murder of Muhammed Nasir from Malaibettu in Sajipamunnur village here by the sessions court here has been cancelled by the high court (HC). The accused have been asked to surrender in the court before January 16.
Muhammed Nasir was killed on September 7, 2015. He was returning home in an auto rickshaw belonging to Muhammed Mustafa from the same village after completing his masonry work for the day, when a gang of four stopped his auto rickshaw. The intruders said they needed directions to certain place, but suddenly attacked the two persons seated in the auto rickshaw with lethal weapons before fleeing. Nasir, whose nature of injuries was grave, died on the spot. Mustafa, who was treated for his injuries, had recovered in course of time.
Accused during arrest
The local police, who tried to arrest the four accused, succeeded in taking into custody Vijet Kumar from Manchi, Kiran Poojary from Badaga Ulepady, and Anish alias Dhanu Poojary from Tiruvail, Mangaluru. They were produced in court and remanded to judicial custody, but within a few weeks, they had succeeded in securing bail.
The family of Nasir approached the state high court, questioning the propriety of granting bail to the accused in a heinous crime within a month of their arrest. The family had requested the high court to cancel the bail. The high court, which heard arguments placed by both sides, and also taking into account the stand of the police department, cancelled the bail, it is gathered.
