Bengaluru, Jul 13: The state high court (HC), which took up an application filed by Eramallaiah, accused in PU chemistry question paper leak scam this year, seeking to nullify the move of the police in invoking provisions of Karnataka Control of Organized Crimes Act against him, invited objections against the application from the government.
The single judge bench of the HC presided over by Justice H Billappa passed this order on Tuesday July 12, when considering the application filed by Eramallaiah.
Advocate for Eramallaiah, Hasmat Pasha, placing arguments before the bench, argued that the said act can be applied only when the accused are active in the field of organized crimes. "Although two cases were registered against Eramallaiah in the past, they pertain to provisions of Indian Penal Code. Out of them, he has been acquitted in one case. The move of invoking the said act against Eramallaiah is illegal. Therefore this should be annulled," he prayed.
