Kasargod: Safiya murder case - Prime convict sentenced to death

Kasargod, Jul 16: K C Hamza, the prime accused in the sensational Safiya murder case that took place in 2006 has been awarded death penalty.

The quantum of punishment was pronounced by the district principal sessions court on Thursday July 16.

Hamza has also been awarded three years of rigorous imprisonment and slapped with a penalty of Rs 10 lac, out of which Rs 8 lac would go to the victim's parents.

K C Hamza (52), a resident of Muliyar Mastikunda, his wife Maimoona (48), M Abdulla (48), a resident of Arikkady, Kumble, were found guilty of murdering 14-year-old Safiya in December 2006. The second accused in the case Moidu Haji and fifth accused Adoor police ASI Gopalkrishna were aquitted for lack of evidence.

Among the other convicts, Maimoona has been sentenced to 6 years of imprisonment in two cases, while Abdulla, who is Maimoona's elder brother, has been awarded three years of rigorous imprisonment. Both of them have been asked to pay Rs 5,000 as penalty. However, Maimoona needs to spend only three out of the six years in jail.

Pronouncing the judgement, principal sessions judge Justice M J Shaktidharan said that a man who had murdered a 14-year-old girl so cruelly was dangerous to society and hence deserved death penalty.

The murder had taken place in December 2006. Safiya, from Ayyangeri of Madikeri had been hired as a housemaid by Hamza and was working in his flat in Goa. While cooking, boiling gruel had fallen on Safiya, causing her severe burn injuries, but instead of taking her to hospital, Hamza kept her at home, fearing that he would be caught on charges of child labour. To cover up, Hamza chopped Safiya into three pieces while she was still alive and with the help of his wife Maimoona and Abdulla buried the body parts near a dam where Hamza was a contractor.

Though Safiya's disappearance came to light in December 2006 itself, it took two years for the murder to come to light, after initial probe by police failed to reveal the truth. Also Adoor ASI Gopalkrishna was suspended on charges of bribery and helping the accused in forging the entry register at the checkpost at the border town of Manjeshwaram to show that Safiya had travelled from Goa with the family in their car, but he was later reinstated due to lack of evidence.

There were no witnesses to the case, and the judgement was pronounced purely based on scientific methods and evidences.

    THE ASI Gopalakrishna should have been held guilty and sentenced to death along the murders. Being a police officer he knew well that law would catch up with him one day so he destroyed the evidence and got acquitted. The family members of the victim should appeal in high court against this acquittal. This is a crime against humanity

    At last the Soul of Safia will get peace now ,justice is done.Hope the conviction will be carried out fast .In India one never know at last what can happen.The Police also should get his punishment.because he tried to Close the case.Poor Girl,she never had the Chance to enjoy the beautiful world but only poverty and work,and die.May her Soul rest in peace.In future parents who send their child to work in someones house ,please try to contact them and findout the Situation.one never know.

    I feel all the three should be awarded death sentence n the police officer shd hv bn sent to rigorous imprisonment as he too is party in abetting the crime...

    poor child of 14 years who went to work has been brutally killed n her killing was later covered up by the accused with help of police by using money power..

    i feel Hamza too need to be cut into at least six pieces whilst he is still alive ..then only i feel justice is done..

    Accused were animal and not a human being. So buried them alive in the same place where they buried the victim of 14 years Safiya. May ALLAH give her JANNAH and tolerance to her family members.

    Hanging is not enough Hot gruel should be poured on this man too. He shut be also cut into three pieces when alive and should be buried under the bridge near the river Thats the way to go about it

    Divya, Mangalore: What you said is absolutely correct. In many of the instances of human crimes, it has become fashion to equate to animal acts. Animals do not kill or attack other animals unless they are threatened or kill other animals unless they hunt for food. Brutal human beings only attack and kill others for many reasons.Jai Hind.

    It should not be dragged further in upper courts.
    Before any ministers come to rescue of Hamza on Humanitarian grounds, the monster needs to be hanged. Only then justice will be done to poor girl.
