Bengaluru, May 22 (DHNS): The vacation bench of the High Court on Thursday imposed a cost of Rs 25,000 to the petitioner, who had sought stay on the swearing in ceremony of J Jayalalitha as the Chief Minister of Tamil Nadu scheduled on May 23, 2015, for abusing the court of law.
While dismissing the petition, a division bench comprising Justice AN Venugopala Gowda and Justice B Veerappa, in the order, stated that the petition is mere abuse of the process of law and has been filed with an ulterior motive only for the sake of publicity.
Coming down heavily on the petitioner, the bench questioned the locus standi of the petitioner whether he knew that the High Court had the jurisdiction to pass order with regard to a matter of a neighbouring state.
The bench observed that the petition has been filed only on assumptions and presumptions and imposed a cost of Rs 25,000 to be paid to the State Legal Services Authority within four weeks.
Arithmetical mistakes
The petitioner, Raviraj Gururaj Kulkarni, an advocate from Koppal district had contended that there were arithmetical mistakes in calculating the loans, in the High Court order, in Jayalalitha disproportionate assets case.
In the petition, he has stated that the percentage of disproportionate assets (DA) is definitely more than 20 per cent as permitted by the Supreme Court.
Sends wrong message
The petitioner said that if Jayalalitha is permitted to take oath of office as chief minister, then a wrong message will be sent to the public.
It will be taken for granted that saying the VIP and VVIPs in the society can do whatever they wish and manage things as per their whims and fancies, the petitioner added.
The petitioner has sought directions from the court to restrain theTamil Nadu government to stop all the proceedings pertaining to swearing-in ceremony as the chief minister of Tamil Nadu.
The bench dismissed the petition with a cost.
