Kasargod, Dec 24: This story seems straight out of Bollywood. Love, music, wedding, honeymoon, court, false case of rape and fake wedding - all the main ingredients of a good script are there in this real story. But as they say, truth can be stranger than fiction, and in this case, it definitely is.
A few days back, daijiworld had reported about a case in which the judge ordered a lady to pay alimony to her husband for filing a false rape case against him and being the reason for his loss of job.
Now, with the emergence of more details which were not revealed in the court, the story has taken a new turn.
D Dharmaraj, the judge in the family court in Kasargod had delivered the verdict directing P M Nivya to pay Rs 6,000 maintenance every month to her husband N K Shivaprasad and also Rs 3 lac as lawyer's fees. Nivya draws a monthly salary of Rs 18,000 from the college in Mangaluru where she works.
The court had taken into consideration the circumstances of Shivaprasad. He had declared that he could not look after himself and pay his legal fees as he became jobless because of Nivya's false complaint. In the compalint Nivya had alleged that Shivaprasad had taken her to different places and raped her.
The police who investigated the case found that the case was false. They discovered that couple in fact had gone to Wayanad and other places on honeymoon. Also, the medical tests done on Shivaprasad were in his favour.
Later, the police registered a case against Nivya for lodging a false complaint. Nivya then approached the high court for anticipatory bail. After the getting the bail, she moved a petition saying that she was never married to Shivaprasad and he was not her husband.
But the truth was completely different. The couple were in love for 8 years before they married on January 22, 2011 in a temple, when Nivya was still studying. The marriage was also registered at Yenmakaje village panchayat on January 31, 2011. They belonged to diffrent religions. There was objection to their wedding from her family. So they got married in a temple. They also called hundreds of people for reception including the police officers and political leaders. Only Nivya's family did not turn up. Otherwise it was a perfect wedding.
When Nivya lived with Shivaprasad happily for five months, she obviously was expecting her parents to patch up with her as it happens everwhere. And a day came in her life when they asked her to come home. Shivaprasad also allowed her to go to her parents on May 1, 2011. But to his surprise, she never returned. Instead she filed a rape case againt Shivaprasad on June 2, 2011. In July 2011, she went to court seeking divorce.
'Nivya was brainwashed'
Shivaprasad now says that he wants his wife back. No matter what has happened between them over the years, he is ready to take her back and wants to live a new life. Shivaprasad's mother says that Nivya was a good daughter-in-law and wants her to come back. She says she spoke to Nivya in the court where Nivya could not talk because she was with others.
Shivaprasad says Nivya was brainwashed by her parents and some relatives. He also alleges that they had arranged an astrologer to tell her he would die within three months if she lived with him.
Nivya was not willing to present her version of the story. Bharathi, an aunt of Nivya agreed to talk to the media on behalf of Nivya. Bharathi says that Shivaprasad is not well mannered and has relationship with many women. She says Nivya was not in love with Shivaprasad but only went to his place because he was a music teacher. When asked anbout their photographs together she says photo does not prove that they were in love. Bharathi tries her best to prove that the marriage between Nivya and Shivaprasad did not take place.
In fact when Nivya had said that the marriage had not taken place at all, the court had called the priest, the invitees in the wedding, the hotel staff where the couple went for honeymoon and the doctor whom the couple had visited during the honeymoon. They all said that the wedding had indeed taken place.
Shivaprasad, a musician knows to play many instruments. But these days he is busy only with sitar. He is completetly down ever since he was charged with rape. Sitar is the only companion for him now and also a stressbuster. He believes and openly says that Nivya she will come back.
Shivaprasad is aware that they only lived together for a few months. He is also aware that they met in court several times as fighting couple. But he still wants her back.
He lost his job because of the false case and then students stopped coming to him for his music classes which otherwise could have been his bread and butter.
Shivaprasad had helped Nivya financially to finish her MSC. He had even bought a car for her so that he could drop her to her college. The multi-talented Shivaprasad lost his job after the case was registered against him. He was even admitted to a hospital on hyper tension. Life became hell for Shivaprasad. He does not want to live in hell forever.
But only music can bring him comfort for him until Nivya comes back.
