Bengaluru, Dec 16: Advocate representing Sri Raghaveshwara Bharathi Swamiji of Ramachandrapura Math told the state high court that they do not have even five percent faith about the possibility of probe into rape allegations levelled against the Swamiji being conducted by criminal investigation department (CID) in an objective manner.
This statement was made by advocate, B V Acharya, representing the Swamiji before the division bench of Chief Justice D H Waghela, and Justice R B Budhihal, on Monday December 15. Placing arguments on behalf of the Swamiji in the appeal filed seeking quashing of the first information report registered against the Swamiji in connection with the above complaint, the advocate also expressed doubt about the veracity of the DNA report.
'Going by the manner in which the probe was conducted, and the stance owned by the agency, we do not have even five percent faith in this investigation. CID did not properly conduct the probe, and the forensic laboratory report does not represent truth. Therefore, we have no reason to rely on the DNA report furnished by the agency,' he stated.
Advocate for the government registered strong objection against these arguments. Intervening in the matter, the bench said that it is for the subordinate court to take a decision on the charge sheet that may be filed by investigation offiers there.
B V Acharya also sought time to file counter objections to the objections filed by complainant, Premalata, and her husband. The bench fixed the next date of hearing to January 6, 2015.
