Karnataka HC rejects bail plea of Jayalalitha


Bangalore, Oct 7 (Agencies):Former Tamil Nadu chief minister J Jayalalithaa was on Tuesday denied bail by the Karnataka high court in connection with the disproportionate assets case.

Justice A V Chandrashekhara turned down Jayalalthaa's plea despite Special Public Prosecutor Bhavani Singh stating that the prosecution had no objection in granting conditional bail to the All India Anna Dravida Munnetra Kazhagam chief.

Earlier, senior counsel Ram Jethmalani, appearing for Jayalalithaa, had pleaded that she must be granted immediate bail pending hearing of her appeal against the verdict of the special court.

Jethmalani pleaded for suspending the sentence pending appeal under Section 389 of the Criminal Procedure Code.

Under Section 389, pending any appeal by a convicted person, the Appellate Court may order that the execution of the sentence or order appealed against be suspended. Also, if the person is in confinement, that he or she be released on bail, or on own bond.

The "regular practice" was to give bail, Jethmalani said, who took up the matter which was posted for Tuesday by the vacation bench on October 1.

Jethmalani cited the Lalu Prasad case in the fodder scam, in which he appeared for him, to press for bail for Jayalalithaa, who is lodged at Parapana Agrahara central prison since September 27.

The high court had refused bail in the Lalu case but it was granted by the Supreme Court, he said.

Jethmalani also said appeals should be heard within a reasonable period of time.

He said there was nothing disclosed in the conduct of the Jayalalithaa to show that she might abscond.

Criticising the judgement of the Special Court in the Rs 66.65 crore disproportionate case, he said assets prior to the period between 1991 and 1996 (when Jayalalithaa was Chief Minister) could not be taken into account.

Matters in favour of the accused must be treated with equal importance, he said. The accused must stand a chance unless the prosecution can prove that it is absolutely false.

Counsel Amit Desai, appearing for Jayalalithaa's close aide Sasikala and her relatives V N Sudhakaran, disowned son of the former Chief Minister, and Ilavarasi, who have also been sent to four years in jail in the 18-year old case, pleaded for bail.

He told the court that no witness talked of assets acquired by the three and suspicion cannot take the place of evidence. They had no involvement in bulk of the assets.

Special Court Judge John Michael D' Cunha, in his September 27 verdict, had held Jayalalithaa and three others guilty of corruption that unseated her as Chief Minister. He had slapped a fine of Rs 100 crore on Jayalalithaa and Rs 10 crore each on the three other accused.

In her petitions seeking immediate bail and challenging her sentence, Jayalalithaa has maintained that the charge of amassing wealth against her during 1991-96 when she was chief minister for the first time was false and that she had acquired property through legal means.

Jayalalitha has also contended that the trial court has overlooked several judgements and has not considered the binding nature of various income tax orders and decisions of the Income Tax Appellate Tribunal, which had accepted the income and the level of expenditure pleaded by her.

Tight security was in force around the Karnataka High Court complex with policemen deployed in good strength anticipating rush of AIADMK supporters and leaders.

    Deve Gowda and his family. Karunanidhi and his family.
    Dayanidhi Maran has a house worth more than 100 crores,
    Mayavathi's bunglow and statues are more than 500 crore.
    Sharad Pawar's assets are close to Billion US dollars,
    Let her spend some time in jail.
    She will not get bail, unless her health detiriorates. She will spend atleast couple of years in jail.
    She is a strong supporter of LTTE.She had compramised national security on several occasions while supporting LTTE.

    It is tragedy of Indian democracy that "queen of corruption" has become God to a section of sycophants in Tamilnadu. Anyway rejection of bails give right message to corrupt politians. Lifeterm imprisonment is minimum pubnishment to such corrupt politians who violate human rights by amassing illegal wealth.

    Denying bail to an accused, especially to a political heavy-weight like Jaya is the best verdict & the judgment should be appreciated for being bold & decisive. It's a shame for a reputed lawyer like Mr.Jethmalani to appear on behalf of the accused & plead for releasing her on bail due to ill-health. He has been representing corrupt politicians, knowing pretty well how they amassed such huge wealth & their corrupt practices. Lalu Prasad & Amar Singh are 2 good examples of corrupt politicians coming out on bail due to ill health & roaming about freely & this lady would have joined the list but for the Karnataka HC Judge putting his foot down & rejecting her plea. It's time the judiciary takes a bold stand & puts the corrupt behind bars & confiscates their ill-gotten wealth & properties & let them rot in jail for ages. That should send a strong message to all those in public life.

    @Henry Misquit, Jaya is not an accused any more. She is a convicted criminal. She will loose all the rights except for the right to appeal before the Supreme Court.

    The judgement and subsequent denial of bail will send the strong signal for corrupt officials. Judiciary can play an important role in reducing the corruption.

    I wish court should have ordered to seize all her illegal assets and hand it over to the government treasury.

    Quantum of Water in Cauvery vary over years, owing to variation of Rainfall. Naturally the water sharing should be base on this. But the madam would stress for table formula if there was drought, & additions if there was excessive rainfall. We should not only look at our share of meal, but also one sitting next us, so that both should have sufficient quantity 'in the available one'. That's what I meant to say. No 'Selfish', but 'Live & let Live'.

    I failed to understand, as to why this greedy old man Ram Jetmalani once upon a time Union Minister in law[I believe] during NDA Government is protecting Corrupt politicians like Lallu,Kanimozi,Jaya etc. My view is that the present Government should re-open all the Disproportionate Assets & Corruption cases of Mulayam,Lallu,kanimozi,Kalmady,Raja, Vadra,Yeddy, Marans etc. & all the money pocketed by them with interest to be recovered. I am sure the total amount may exceed more than the money stashed in Swiss Bank Accounts.

    I NEVER EVER THINK THE JUDGMENT IS BASED ON WATER ISSUE.

    THE JUDGMENT WAS PURELY ON GRAFT/CORRUPTION ISSUE.
    IN CASE THIS CASE WAS IN TAMIL NADU COURT, SHE WOULD HAVE BEEN ACQUITTED.


    The cavery water should be distributed equally as per the availability of water in the reservoir.

    For the same reason case has been transferred to Karnataka by Supreme court because of the concern that she may influence court/judges in her own state.

    Supreme Court also should reject her bail plea if it has any SELF RESPECT because the SPECIAL JUDICIAL BENCH has been setup for probing DA case under the guidance of Supreme court.

    Bhandu Mam, once upon a time she had proportionate assets. As years go the assets became disproportionate. Now all Jaya like ladies whose assets were proportionate once but now disproportionate are a worried lot with fear of jail. This is not fair! What you say?

    and the 'dis' ones too.
    You are correct.
    What is 'prop' at 16 becomes 'disprop' at 66. You have to carry it off with grace though.
    Many maintain till 46,some till 56. Then interest goes.
    Should not be...
    'Body is the temple where soul resides' and care should be taken to maintain it in good shape.
