Michael D'Cunha: The no-nonsense Mangalorean judge who sent Jaya to jail


Bangalore, Sep 27 (PTI): Special Judge John Michael D'Cunha, who convicted Tamil Nadu Chief Minister Jayalalithaa in the disproportionate assets case on Saturday, has a reputation of being a no-nonsense judge who gave an indication of his stern approach while dealing with the politically volatile case.

D'Cunha, who has grabbed attention for delivering the historic verdict and is the man of the moment, is the fifth judge to deal with the 18-year-old case after it was transferred to Bangalore by the Supreme Court in November 2003.

D'Cunha, hailing from Kaikamba, Mangalore, had started practise as a lawyer in 1985 and was selected to the post of district judge in 2002. He served in Dharward, Bellary and Bangalore in various positions, including as Secretary to the Chief Justices and as Registrar (Vigilance) of the High Court prior to his present posting.

The DA case against the AIADMK supremo that took nearly 11 years at the Special Court in Bangalore to reach the stage of final verdict, witnessed four full-time judges before it landed in the hands of D'Cunha.

AS Pachhapure, the first judge of the Special Court, assumed the post in December 2003 but he could not conduct proceedings from August 2005 as the Supreme Court had stayed the order passed by him by clubbing the two cases into one case of disproportionate assets. The post fell vacant in July 2007 when Pachhapure was elevated as a judge of the Karnataka High Court.

Later AT Munoli took charge as the judge but no effective proceedings were held during his tenure due to Supreme Court's stay order. After his retirement, B M Mallikarjunaiah was appointed to the post.

The trial had made substantial progress as crucial proceedings like re-examination of some of the witnesses by the prosecution, recording the statements of Jayalalithaa in person, etc were conducted during the tenure of Mallikarjunaiah, who retired in August 2012.

M S Balakrishna took over the position in November 2013 and he completed the process of recording statements of three other accused and had almost completed the recording of final arguments when the controversy arose about the certain procedure adopted by him and the new Special Public Prosecutor G Bhavani Singh.

Though Supreme Court upheld the procedure and permitted to continue the service of Balakrishna beyond his retirement for completing the trial, he refused to continue after his retirement on September 30, 2013.

Following this, D'Cunha was appointed to the post in October 2013 and he heard the final arguments afresh. He had passed strictures against the accused and their counsel.

During the course of hearing of the final arguments, he gave an indication of his stern approach by rebuking the defence for what what he called attempts at "protracting the trial and suppressing the facts from the Court."

    Mainly 2 points arises-1) whether the flow of money in various company is derived from corrupt practise being Public Servant ? and 2) whether earlier earned money as an actress and gold she was in possession to be excluded though she or her legal advisor reported wrongly to concerned authority when Jaylalita got elected for the first time as an M.L.A. ?
    On this I doubt upholding of conviction Judgement by appellate court.

    All said it. I was sure he will pronounce what's due. But what I worried for was thereafter, especially seniors like Ramjethmalani descended on the scene and saying so many things.I'm not a practising lawyer but an enthusiastic ex-student of law following important cases. And especially when the vacation judge advanced the hearing from 6th to today 1st (oh, the outcome is also fitting). I was little worried, the good work of Justice D'Cunha should not go waste, if the vacation judge grants her the bail hard fought by heavy weights like Jethmalani. Nevertheless one day she might get a bail after sometime either from the HC or SC, but not immediately after the D'cunha's bold judgment on some intriguing technicalities which I'm presently now aware. I know apex courts decide many cases on technicalities even on cases where the guilt was proved beyond doubt (remember her own TANSI case which was a sure shot). My fear is such things shouldn't happen in this case otherwise we citizens shouldn't lose faith in our judicial system as culprits at high places escape thru' loop holes, thanks to eminent lawyers. Good work Mr.Justice, may God bless, keep it up. Expect you soon on the bar of HCs. All the best Mr.Justice.

    Sometimes I wonder whether we live in the most dictatorial democracy of the world???

    Ministers, MPs, etc. used to bow at the feet of amma (out of fear and not out of respect) in public functions without shame.

    Amma's gimmick of fooling people by taking salary of Re.1/= per year,
    squandering public funds for her adopted son's wedding, amassing unaccountable wealth by fooling voters with gimmicks such as amma dosa, amma idli, amma cement, amma condoms didn't protect her from the long hands of our country's law.

    It is so unfortunate, that we as Indians do not or couldn't come out strongly against these type of corrupt leaders all over India the reason why many are still in the state and national govt. untouched by the hands of law.

    Hope our own T.J.Abrahma, Doraisamy, Hiremath, Santhosh Hegde etc. will come forward to eradicate the corrupt deeds of both BJP, Congress and others in the sate as well as on the national level.

    Cleansing our financial and political system is of top priority than cleansing the Ganges (although it is necessary, and although it will give more room for corruption).

    “He has been an upright man and honest to the core. We are happy that John Michael Cunha has delivered this important judgment,” said Mr. Ullal.
    Mr. Ullal, Mr. Kini, M.P. Norohna and Mr. Cunha joined together to form “Manu Advocates” firm.
    Mr. Cunha was associated with the firm between 1994 and 2002, when he was directly ed as a District Judge. “Such judgments repose faith of the people in the judiciary and dispel doubts that judges yield to pressure.”

    Surprisingly he went with Jaya during 1998 to 2000 ..!!

     according to Dr. Swami , 1996 she was corrupt , and 1998 she was saint and after that she again corrupt.

    Don forget, because of her, he entered Loksabha during 1998 and Jaya bargained a lot with Vajpayee to get FM portfolio to him . And along with him she toppled Vajpayee Govt. Then swami fought with her again…!

    Now what we can tell about a person who proclaims Jaya a corrupt politician on 96 and same Swami says Jaya a “saint” on 98. This Swami once during 1988 said Rahul is genius , and RSS is thug organization.

    Now his position is completely reverse. He says Rahul is “Buddu” and RSS is “patriotic “ Usually persons call such persons “opportunistic” rather crusader… ! But I call him “Political prostitute “ …!!

During 1998 he quoted about this case “error of judgment” and he said “he should not have filed it”…!! Crusaders file case not only Jaya or Sonia but also Yeddi and reddies..…!!     I only understood that he is treating his widowed daughter in law as his own daughter and arranged a groom for the widow...
    I appreciated his beg heart to have great affection for his BAHU, which is missing in the society...
    Some dirty people even think it is BAHU's bad horoscope killed the son..
    But I felt this man is an exception. I never see such news from politicla angle. Even if that person belong to Cong or CPIM, I woul have appreiated him...

    Regarding 100 crore, I am not sure whether he earned by wrong means. If so, definitely local cong might have already files complaint to win in politics. Right?

    I am not advocating the argument that people who have money must distribute all their money to poor. Only my request to them is please pay tax, which will reach poor through government.     Swamy is good person, that you need not know. If judge like D'Cuanha knows and takes up the cases filed by Swamy, he got his respect. You must note that judge D'Cunha (or any other judges) does not conclude Swamy as bad, he will be considered as good person.

    In another article titled 'India, China cooperation will help develop the world: Modi', dated September 16, 2014, Mr.KRPrabhu in his comments was questioning how many Christians were/are there holding high office in India.


    In my reply to Mr. Prabhu's comments which I found were quite provocative I had commented that though our Christian community was small compared to India's population our contribution was as important as anyone else’s as every little contribution to the nation matters whether it be in the field of education, health, charity, armed forces, etc.

    I reminded him of IAF Wing Commander Darryl Castellino who died while rescuing 'Hindu' pilgrims trapped in the Uttarakhand floods last year.
    Today I can also proudly say that my chest feels like size 56 inches with the verdict of our community's Honourable judge John Michael D'Cunha.

    Police Commissioner Julio Ribeiro was an upright police office par excellence.
    He survived two assassination attempts.

    Once in Jalandhar, Punjab while serving as Director General of Punjab police he survived an assassination attempt by Sikh militants. It was reported that he dived to safety (at that age) to avoid their bullets.
    Another time in 1991 he survived an assassination attempt again from Sikh militants in Bucharest when he was Ambassador of Romania.

    I salute the Judge D'cunha for giving the historical judgement fearlessly upholding the principles of justice.Had we had few Judges like Mr.D'cunha in the country,mega scams like 2G,CWC,Adarsh Hsg,Coalgate scam siphoning crores of rupees from the country's treasury would not have happened.Natural Justice is expectable only when the Juddge comes from a humble ordinary family and also his family has no big business connections which makes him to tremain always in fear of vidictive actions from the political side.This apparent in Karnatakata Mining scam report.

    Politicians are very intelligent and know the nuisances of law. Most likely she will go to higher courts and bail to follow. The crime is just disparity of wealth , but there are far enourmous crimes which deserves headlines. Some people citing.' divine blessings ' here , but can they forgive the convicted !?. NO! , then why act ' HOLY' !?.

    Judge D'Cunha has done his job and has done it right. There were ample evidence to convict Jayalalitha for disproportion of wealth. The expenses of about 50 crores for her adopted son's wedding itself was good enough evidence for disproportion wealth. Any upright Judge would have convicted her.

    Judge Michael should have ordered seizure of all her assets and given her at least 15 to 20 years of sentence and some other restrictions such as not to involve in politics directly or indirectly.

    Note: Jayalalita was not expecting this verdict as her party members brought sweets and fire crackers to celebrate..4 Years and Rs 100 crore fine !! From Palace to Prison..!! What a great verdict it is !!
