Mangalore, Apr 5: The first additional civil court here has granted a temporary stay on the Mangalore City Corporation's proposal to disconnect water supply to Fr Muller institutions.
The civic body had termed the connection to the institutions unauthorized and had disconnected the supply without prior notice. It also served a notice on Fr Muller institutions and sought explanation within three days. The institutions were left with alternative to seeking legal recourse to the issue.
First additional civil (senior division) and CJM S R Tulasiram, in a 109-page ruling dated April 1, has issued a stay on the mayor's order. The ruling says that the MCC has failed to prove with evidence that the water connection in question was illegal and it was improper to sever the water connection to a group of institutions with a record of 126 years of service in public interest. It also clarified that neither MCC nor the mayor had any authority to disconnect the water supply on the grounds stated in the MCC order dated March 5, 2006.
Hence, adds the ruling, the disconnection on February 21 without any enquiry was a unilateral and illegal step.
