Bengaluru, Dec 15: The state high court, on Tuesday December 14, quashed an order passed by the 8th additional chief metropolitan magistrate (ACMM) court here relating to an order passed to hold an inquiry against city police commissioner, Kamal Pant, and two others. The said order had been passed on the basis of an allegation made by a journalist, Dinesh Kallahalli, accusing Kamal Pant and others of failing to register a first information report against Ramesh Jarkiholi based on his complaint relating to obscene CD involving Ramesh Jarkiholi.
The single judge bench of the high court presided over by Justice Sreenivas Harish Kumar which heard the petitions moved by IPS officer Kamal Pant, deputy commissioner of police, Anuchet, and Cubbon Park station inspector, Maruti, cancelled the said order of the magisterial court.
The bench said that the complaint had been registered without bringing the true facts to the notice of the 8th ACMM court. Therefore it opined that the magistrate was not right in passing an order to hold investigation by coming to the conclusion that the police officers had committed dereliction of duty.
