Beltangady, Jul 8: As per the orders of the high court, the case pertaining to the allegation of rape levelled by a lady against the police sub-inspector (PSI) of Chamarajpet Bengaluru police station has been shifted to the criminal investigation department (CID). Officials are continuing with the investigation now.
The complainant said that she had visited Chamarajpet police station in August 2020 to file a complaint about the theft of her laptop. "I came across police sub-inspector Vishwanath Biradar there. In course of time, we came to know each other more and he proposed marriage. On November 10 last year, in the guise of marriage, he took me to Dharmasthala, rented a hotel room and had sex with me against my wishes. Thereafter he refused to marry me," the lady in question had said.

The lady had filed a complaint against the accused policeman on November 11.
On the same day, Vishwanath had filed a counter complaint in the same police station. Biradar said in his complaint that the lady had pressurized him to marry her and threatened to commit suicide if he refused to marry her. She also threatened to file rape case if he fails to pay her ten lac rupees, he stated.
Immediately after the rape charge was levelled, the sub-inspector was suspended from service. The anticipatory bail application moved by Biradar had been upheld by the district sessions court on December 19, 2020. The aggrieved lady filed a petition in the high court seeking cancellation of bail granted to the sub-inspector. A high court bench of Justice H P Sandesh had recently upheld her petition and directed the police to arrest the accused immediately and subject him to investigation.
The court observed that in spite of the existence of a serious allegation of sexual atrocity, the police have extended protection to the accused. They just filed a first information report and failed to do anything more. The police clearly have been trying to shield the police sub-inspector and helping him to escape from the hands of the law, the high court opined and ordered the probe to be handed over to the CID. It had asked the investigating officers to complete the investigation in four months and file a final report. Accordingly, all the documents and things relating to the case have been handed over to the CID office at Bengaluru.
The lady who personally argued the case, said that the police, instead of providing her justice, had meted out harassment and mental torture at the hands of the police. She said that the police have not taken any action against the accused and therefore her fundamental rights have been violated.
She also claimed that because she filed the complaint, her character assassination was resorted to. "No one else should go through the problem and pain I went through. Therefore, the anticipatory bail of the accused should be cancelled and the case should be handed over to the CID for impartial investigation," she had pleaded.
