Bangalore, Jul 22: The public interest litigation filed against the appointment of Justice S B Majage as the state Lokayukta, came up for hearing in the division bench of the High Court comprising Justice N K Patil and Justice A S Bopanna. The bench had set Wednesday July 21 as the date for hearing the case, when the litigation filed by city-based advocate, R L N Murty, was referred to it on Monday July 19.
On Wednesday, Justice N K Patil recused himself from the hearing, without citing any reason. He directed the HC registry to place the case before another HC bench for hearing. Murty has sought the quashing of the appointment of Justice Majage, alleging that it has been done in violation of section 11(e) of Administrative Tribunal Act 1985.
In the meanwhile, the condition of Upa Lokayukta, Justice Majage, who suffered heart attack and was admitted into Mallya Hospital here on Tuesday, is reported to stable. The doctor attending the Upa Lokayukta said that Justice Majage was taken off the ventilator, but that he would remain in the intensive care unit of the hospital for at least three more days.
