Bengaluru, Nov 26: In order to escape from unnecessary financial burden for the government and harassment for the employees, the government has made the system of suspension more stringent. The modified order, with certain changes, was announced on Wednesday, November 25.
In the cases of dereliction of duty, power misuse and other allegations, a deadline of six months has been prescribed for filing a charge sheet against the suspended employee. If the competent authority fails to ensure this, the suspension order automatically gets cancelled from the day the suspension period is completed in six months. Same rules apply for Lokayukta cases too. Changes have been made to this effect Karnataka Civil Services (classification, control and appeal) rules 1957 and the department of personnel and administrative reforms has issued an order on Wednesday, November 25.
The new rules brought in place of old ones through amendments: Either departmental inquiry into the accused employee should begin within six months or suspension or charge sheet should be submitted in the court. If the concerned fails to take a decision within this period, the suspension automatically is deemed to have been lifted. Same rules apply to cases registered by the Lokayukta in corruption cases. The employee, after the suspension ends, has to seek an order of deployment from the appointing authority immediately otherwise it will be treated that he absented from attending to duties without authorisation. If the departmental inquiry does not begin or charge sheet is not filed within the prescribed period, the competent authorities can decide about deploying the person back in service. After the suspension is lifted, the employee cannot be appointed to the same place or position he occupied at the time of his suspension.
