New Delhi: Supreme Court Blow for Reddy Mining Company

HT

New Delhi, Dec 18: The Supreme Court on Thursday, Dec 17 restricted the Reddy brothers from carrying out mining operations in Anantapur district of Andhra Pradesh.

The bench headed by Chief Justice K.G. Balakrishnan stayed an Andhra Pradesh High Court order that allowed the mining and transportation of iron ore by Obulapuram Mining Company (OMC) Private Limited.

Karnataka minister G. Janardhana Reddy owns the Obulapuram Mining Company.

The court refused the OMC’s plea of not passing any order till January 4, the next date of hearing. The bench said:

“How can the whole matter be disposed of by an interim order?”

The apex court was hearing a petition by the Andhra Pradesh government challenging a December 11 high court ruling that suspended a state government order prohibiting mining activity by the company.

The order was issued following a Supreme Court-appointed Central Empowered Committee report that recommended a immediate ban on mining by the OMC in the area.

The panel was constituted to inquire into the matter based on a writ petition filed by Tapal Ganesh of Bellary against the OMC over the alleged illegal activity violating the Forest Conservation Act.

Hi GV Bangalore, Well said. All of us Daiji readers should understand that only Law will help us achieve our "SuperPower" dream. We all will be "PSUEDO SECULARS" if we justify the wrong/bad things by using the past examples. this approach will only take us back and will not provide any good future for the new younger generations. Also, a "Glass Breaking" can be a big or small news based on what it is used for. A simple "stone" can be priceless based on what it resembles. We need a united India for our younger generations. Time for Sc to clear the rotten eggs in the lower courts where law is being bought and sold.

Hope the Supreme Court finally nails them. Stay orders and their suspension are just small steps. The CBI should be allowed to get at the truth and directed to inquire into all allegations of illegal mining and other irregularities not only in AP but in Karnataka too. The findings of Karnataka Lok Ayukta should be thoroughly examined. The role of the AP High Court and its Division Bench in suspending the stay order issued by the Government must be probed. While one cannot impute motives to the AP High Court Division Bench, one wonders WHY IT COULD NOT HAVE SUSPENDED THE STAY TILL THE NEXT HEARING OR AT LEAST PREVENTED THE TRANSPORTATION UNTIL DISPOSAL OF THE CASE? IF THAT WAS DONE, ONE WOULD HAVE ACCEPTED THAT THE DECISION WAS FAIR AND JUST? IF THE FINAL FINDING PROVES THE CHARGES, WILL THE CULPRITS RETURN THE LOOTED PRECIOUS MINERAL WEALTH? JUSTICE SHOULD NOT ONLY BE DONE BUT SEEN TO BE DONE IF ORDINARY PEOPLE SHOULD CONTINUE THIER TRUST AND FAITH IN JUDICIARY. DETAILS ON THE SCANDAL INVOLVING KARNATAKA'S CHIEFJUSTICE DINAKARAN ARE PUBLISHED IN NEWSPAPERS DAILY. THIS SHOULD BE A WARNING AND EYEOPENER FOR ALL!

The reddy's thinking that they have a clout over Bellary and Andhra have succeeded now will have to think how to tackle the Supreme Court. The Bellary district has been completed ruined by Reddys by ripping through the mines thereby the Ground Water source for human consumption being completely destroyed.

We have a very weak CM who has expressed his helplessness of Illegal mining and it is time that the Governor who is taking active interest interferes to save the Bellary district from these mine Sharks. The Ex CM of Andhra YSR and the Reddys were actively involved in this illegal mining. It easily justifies that the YSR's son who was a nobody accumulated illgoten wealth within a short period thereby paying the Highest income tax amount in Andhra.

It is time that the Voters and the Citizens alongwith Indian Judiciary play a greater role in saving India and t his earth. Though we are not getting good elected representatives in this country a few of the clean minded poeple can make a difference in teaching a lessonto these elected representatives. I am sure very shortly Reddys and the CM will be taught a lesson that they have to not only respect the voters but also the mother earth.

Very good decision from the SC. It is very encouraging to see the judiciary making very good decisions (something unheard of) in matters related to national interest. Unfortunately the elected leaders (all parties and all government including state and central) and doing nothing to stop illegal activities. Sad to see the state and central governments taking any action only after SC's intervention. Still There is hope that Law will be upheld by the supreme court.
