Bengaluru, Feb 5: Karnataka high court has delivered its verdict on the petition that was submitted asking for the cancellation of bail given to Nityananda.
Lawyer arguing for complainant Lenin had argued in the court on February 3 and has said, "Nityananda, who is accused of rape has absconded from India. His passport validity is over. Even then he has undertaken foreign tour. Second accused in the case has also not attended the hearing of this case. So the bail of Nityananda should be cancelled."
On February 3, the Karnataka police had conveyed to the high court that Nityananda is on a spiritual tour. So the notice that is given to the Swamiji is not possible to be delivered to him. This affidavit was submitted to the court by the Karnataka state police during the inquiry of the appeal for rejection for bail for Nityananda.
DySP Balaraj B had said in the report that was submitted to the court that the notice served by the court on Nityananda cannot be handed over to him as he is not there in Bidadi ashram of his. The notice is given to his mediator Kumari Archana.
Justice John Michael D'Cunha had expressed his anger over the report submitted by the police and questioned them by saying, "Is this the first time that you are handing over the court notice to someone? Don't you feel ashamed to give such a lame reason to the court? Are you playing?"
There were rumours from a long time that Nityananda has escaped from India. However, his disciples had said that those are baseless rumours and he has gone to North India for long time penance. However, Gujarat police had later confirmed that Swami Nityananda had indeed escaped from the country.
The report of Ahmedabad police says, "Nityananda, who is infamous through controversies had shifted to his branch in Ahmedabad as soon as accusations of sexual assault of him became public. Later he was not seen in his Bidadi ashram at all. Recently, Nityananda had released some clips of his discourse on Youtube. However, none of those videos were recorded recently. Nityananda swami has not come to Bengaluru since many years. He has left the country and it is futile searching for him in India."
Recently, a disciple of Nityananda had accused that his daughter, who is in the Gurukul of the ashram of Nityananda is being sexually exploited and that the parents are not being given chance to meet her also. Then the whole case had seen many turns and twists.
Nityananda had tried to escape from India in 2018 itself. He had given his passport for renewal in mid 2018. However, the then SP Ramesh Banot had not given consent for the same. After that Nityananda had shifted to Gujarat.
According to sources, Nityananda must have used either a duplicate passport of his identity to escape from India or else he must have got the passport of some other country for escaping or there is a possibility that he might have got his passport renewed through dubious means.
