Mangaluru, Dec 14: The second additional sessions court, which also happens to be the designated court for Protection of Children from Sexual Offences Act (POCSO) cases, has concluded that the charge of raping his daughter levelled against a man has been proved. The girl, who was repeatedly raped by her father, had conceived.
The court, however, has reserved its orders on quantum of sentence.
The person found guilty by the court is Kishore Bhayya (36) from north India, who currently lives in the city. He had raped his 13-year-old daughter several times.
Judge of the court, B R Pallavi, in a judgement delivered on Friday December 13, found that the charges of rape under section 376 of the Indian Penal Code, 506 (death threat) and sections 5 and 6 of POCSO Act relating to repeated sexual atrocity have been proved.
When his wife was admitted for delivery into a hospital in 2016, Kishore Bhayya had cajoled his daughter into having sex with him and then raped her. As he had also posed a threat to kill her, the girl reportedly remained mum on the issue. He thereafter raped her several times, as a result of which the girl became pregnant and gave birth to a baby girl. Thereafter, the harassed girl's mother filed a complaint in women's police station here against her husband.
Police inspector of the station, Kalavathi, who probed the complaint, filed a charge sheet. 12 witnesses and 24 documentary evidences were taken on record before passing the judgement. The DNA test of the baby proved that Kishore Bhayya is its biological father.
Special public prosecutor, C Venkataramana Swamy, argued the case on behalf of the prosecution.
